Not necessarily. If the guy got out of his car, was in the lane at all, and it was dark then it’s plausible Boeheim didn’t see the guy until it was too late. Sadly, it happens here all the time when people break down on the interstate and start walking to the ramp.

nearly hit a hitchhiker on my way home from work at 1:30 AM one day b/c he was walking in the lanes of travel as I was coming around a curve... I barely swerved to avoid him

Not sure about texting, but his BAC was .00. He wasn’t drinking.

I was a passenger in a car that hit a kid in Tuscaloosa in 2009. I still remember the glass shattering on me from the impact. He was stumbling drunk and tripping balls. We called the cops immediately and he survived, but I was fricked up about it for a long time. Started snorting blow and drinking a ton to numb myself about it. I feel for Boeheim and wouldn't wish this on anyone.
