Hoda's dad was a foreign diplomat from Yemen, which would mean she wasn't automatically a US citizen by being born here. That's Pompeo's legal standing. Her attorney is arguing that her dad was no longer working as a diplomat at the time of her birth, so she should be a citizen by birth.
Going to be interesting to see how this plays out in court. If Hoda's citizenship argument wins, does she return to the US where she's going to face charges for joining a terrorist organization, aiding and abetting the enemy, and possibly treason and possibly spend most of her life in prison?

Did her dad’s immigration status change prior to her birth? If not, it doesn’t matter whether he was still officially a diplomat or not. If he or his wife shifted their status prior to her birth than they may have a argument. Still, she can and should have her citizenship revoked. She joined an enemy of the state and on top of that encouraged violence to Americans.

Yep. If he/they was/were still in the country on his diplomatic visa, she's not a natural born citizen, regardless of whether he was 'officially' still on the books at the Yemeni embassy.

If done voluntarily and with the intent to relinquish citizenship, the following acts will cause you to lose citizenship:
Serving in the armed forces of a foreign country engaged in hostilities against the U.S.
Taking an officer position in the armed forces of a foreign state
Being convicted of treason
Taking an oath or affirmation to a foreign state
Working for a foreign government when you are of that nationality

So why was her dad still here in US if he was no longer functioning in the role that brought him here originally? Is he still here? Is he on some type of visa or something that gives him permanent status?

It is not uncommon for diplomats to apply for and receive permanent visas for them/their family after they complete their diplomatic mission. It should come as no shock that diplomats from shitholes like Yemen often find that they prefer the American way of life to their home country while they are here.

The foreign diplomats children not being granted US citizenship is the same reason why illegal Aliens children should not be citizens.
The clause that grants birthright citizenship includes the phrase 'under the Juristdiction thereof'
Congress passed the constitutional act that made diplomats children born in the US non-citizens. Congress can also pass an act that makes the children born to illegal aliens also not citizens, since they also fall under the same constitutional phrase.

If the diplomat rule doesn’t apply, this could be the a great way for justice amy to eliminate anchor baby citizenship via Supreme Court ruling.
