LA is so fricked. You can drive with no insurance and yet sue the other person after a wreck? That’s gay.

That’s not really accurate
The reason it’s only the first $15,000 forfeited and not a complete bar to recovery is that we don’t want to place the burden on the State. My coverage lapses and I’m rear ended by a commercial vehicle and it snaps my neck and makes me a quadriplegic... public policy is we want the burden to stay with the private tortfeasor and their insurer rather than shift me on to the public dole.

Eta: coverage for deductibles and extra medical coverage for limits on your hc plan coverage.

If I hit someone and mess them up. I hope they get every penny my insurance policy holds. Very rarely will PI lawyers go for judgements above your policy limits unless you’re underinsured or the client is seriously messed up or dead.

Sue the state because the timing was off on the red Light or the view was obscured or the pothole made someone bounce through while trying to brake.

I don't have it and have been hit by a uninsured motorist. My collision covered repairing my vehicle, no passengers were injured, but if they had been I have liability coverage, if I had been injured I have medical coverage, I don't work, so income remains the same, when I did work I carried sufficient disability insurance. And as in the case of the OP if I were to get sued, again I have auto liability coverage and a large umbrella policy. The lack of the additional premium for uninsured motorist more than offsets my deductibles if I go a year without using any of my insurance.

Texas has an insurance database the cops can access to confirm coverage. Texas drivers still must carry proof of insurance (paper or cell phone) because the law never changed about requiring the driver to produce proof upon request.

How do they not assign fault? I thought they always did to a degree unless it was on private property where there is no right of ways?
Im pretty sure I would have raged hell if someone hit me, it was clearly their fault, and the cops said I was equally at fault.

Well if LA is like AL, they have a racket going. Here in AL, every crash that pulls in from an MVR lists as "at fault". So when I run a report and an MVR pulls an accident, even if the driver was rear ended at a stop sign like one I processed today, it shows as at fault and jacks the rate up. Then it has to be disputed...well of all things shocking, you basically have to pay $15 to get an accident report to clear things up. What a bunch of crap...listing shitty, bad info then charging $15 to clear the bs up. Your government doing work!
