It's just bad form and dumb on the cops part. I'm not saying he forced himself on her, I'm not saying he didn't either. We don't know what happened there.
But he had to know it was a dumb, risky move on his part and he was putting himself in a situation that could easily turn bad for him.
This isn't a guy meets girl at a bar and they're both drunk and go home together situation.

I agree that we don't know the facts, but considering the decision making skills of a cop who screwed her during his shift, I don't think it is much of a stretch to think he could have forced himself on her.

That's my initial thought as well but the lawyer's statement makes me think twice about that as he seems to take more issue that the cop would actually go inside and do what he did while on the clock, rather than the actual sex act itself.

lots of angles to this story, but it seems like he was stalking the "victim". I mean he just happens to see them leave the bar, pulls them over, and so on.
then again, why the "victim" didn't just accept her guilt and shame for being drunk and horny instead of calling the cop and setting him up, is just as strange.

I get that as well - it may be a negotiating tactic to increase public scrutiny on the case.

I'm actually surprised with the protocol for female transport by a male officer. Back in the day when I worked for CPSO, we called for a female officer to transport a female. Now that wasn't always possible, but in the event of not having that type of transport, we had to log in departure/arrival times and such.

If the Chief of Police had balls his Press Release would read as follows:
"We fired Officer Bennett today not for giving the girl a ride, not for going in her apartment and not for having sex on the clock. We fired Officer Bennett for being a dumb arse that shouldn't be carrying a gun if he can't make good basic decisions such as the ones he failed to make in this case."

When it's a hot piece of arse (surely he wouldn't make this move for a OT 5) leaving the Bulldog that's willing and able, you throw out the rule. I'm surprised he didn't claim overtime.

That would be a valid comparison if the story was that the cop went to his own house and fricked his own woman while on the clock. But that's not the story. This isn't a girlfriend or a frick buddy or anything like that... this is a person he was supposed to be ARRESTING for DUI.
Doctors can't frick their patients on the job. Professors can't frick their students on the job. I mean, this isn't exactly rocket science here

You are correct except for that she was the passenger and not subject to arrest. Which brings up the fact that they can't just leave a drunk woman on the side of the road either. In this situation, they should have either called her a cab or driven her home but carefully documented the event so there wouldn't be allegations later. I am befuddled that he would have let this happen. Hell, if she was good to go he should have said "I will be back after work / give me your number."
