How can this even be proven?

Yes it was rape ... You can't give consent she you are intoxicated

She just can't remember, so she turns to thoughts of her complete innocence, assumes that she was non sexual with him, and will ruin some guys life because SHE drank too much.
I'm a complete believer in the "drunk words are sober thoughts" saying. Might have to change it to "drunk thoughts are wasted actions".

Alcohol is an integral part of the college experience and the society we live in, for better or for worse.
True, but you have to know your limits.
quote:
Alcohol also makes people more vulnerable.
Correct, which again is why you must use it responsibly.
quote:
But everyone has the right to get as drunk as they want to without the threat of being raped.
So if he was blasted too, how is he supposed to know that you are too drunk? Should he not also have the right to get too drunk to not worry about the possibility that you are not in a sound state of mind? Why is it is his responsibility to to protect himself when he is drinking and not yours too?
quote:
Victims did not “put themselves in that situation” as a result of having been drunk.
If this were true, then public intoxication would not be a crime.
I'm not saying that I can't be empathetic for this person, but it's truly sad that we have created a victim culture totally devoid of personal responsibility.

so if the guy was drunk, they raped each other?

If both people are blackout drunk it's one thing, if one is and the other's nearly so er it's another.
Also if anyone had sex with her after she passed out, that's kind of unquestionably rape.

If having sex with a drunk girl were rape, 90% of the heterosexual male population would be in prison.

Some rapey mofos up in here.

It's a necessary contradiction. Most criminal acts require the mental intent to commit the act in order to be convicted. So what's stopping someone who is interested in robbing a bank from taking some shots before hand and claiming that he only robbed the bank because he was drunk. that he never intended to rob it?
That's why every state has a law stating that criminal intent cannot be denied based on a defendant's willing ingestion of drugs or alcohol. The criminal justice system simply wouldn't work if people could get out of any charge by smoking weed or whatever before the crime.
But if both parties were obviously intoxicated then both could not consent and they both raped each other.

well the problem is that even assuming that teh guy is 100% sober, she still could have told teh guy yes or even initiated the sex
Right. And as I said, I'm judging this off her one-sided account with the caveat of "if" she's telling the truth.
quote:
"blacked out" is NOT "unconscious"
That's fair. I shouldn't have conflated the two. But still, "blacked out" is effectively out on your feet, to borrow a boxing term. You may be moving about, but by the time you're at the point where you aren't going to remember shite, you're generally impaired enough that it's more than noticeable. To casual observers--sober and drunk.

In her own words...
quote:
In my case, and in many other cases of sexual assault on campus, alcohol played a role for the perpetrator as well. This does not excuse his guilt. Whatsoever.
So she acknowledges that he was drinking as well. Again, not enough details to know if he was black-out drunk or just buzzed, sort of like the lack of details on how she got him off of her.

I have never had sex with a drunken woman while I was sober. Mostly because drunk people are annoying as frick if you aren't as well, and annoying white girl blabbering is a boner-killer.
I have, however, had sex many times when I was trashed and a woman was trashed. In no instance have I ever been accused of raping or assaulting the woman...mostly because we both know what the frick is up. It isn't difficult.

Should we tell women "Don't spread your legs when you're drunk. It's not that hard."
Post that on Facebook and let me know how it goes
