This seems to be the case...
LSU has already taken action against Chavis and it preceeded Chavis' action against LSU & aTm. LSU will be the plaintiff and Chavis will be the defendant. That won't change because the damage was caused to LSU not Chavis.
His actions prior to and immediately after the bowl game tell a much different story than a guy who was employed through the date that he claims. The details that will come out under oath will only make him look worse.

It's not sealed. I'm sure his contract is dated correctly. A judge in Tx can rule as he pleases.

I hope you are correct. We need to control the venue.

How can he recruit if he was not technically employed by A&M? Let's see if the NCAA comes down on them, especially after the Womack fiasco!

without reading every thread,if Chavis wins his case .LSU has a case against him for recruiting for another school while still employed at LSU.Surely somebody will inform NCAA,on top and A&M will be in trouble.

If A&M wanted him so badly, why not just offer to pay the $400K when you tried to bring him on your staff?

I'm not an attorney but how is venue proper in a Texas court. The contract was entered into in Louisiana. I'd imagine it has a provision that any disputes will be decided according to Louisiana law. I understand that Chavis went to Texas but I don't understand why a Texas Court would have jurisdiction over a contract entered into in Louisiana between a Louisiana institution of higher learning and a Louisiana resident. Perhaps an attorney can explain this.

I wonder if he went on the road and recruited his lawyer?!

I think LSU should keep the legal action alive as long as they can. There is no loss on the LSU side other than money. It gives LSU recruiting points to parents of recruits.

Everyone's missing the play here. The only way that Chavis could file suit (and select the venue (Brazos County)) is if A&M took the position that it didn't owe him anything. Therefore, he files for a declaratory action in Aggieland beating LSU to the punch in being able to file lawsuit for damages in EBR Parish. Of course, A&M will pay the judgment if a court in Aggieland says Chavis is on the hook, but what do you think those odds are? Alleva outflanked once again.....
+1
Bad move by Aleva. If you truly wanted to get the 400k, instead of posturing like he obviously did, Aleva should have been running to the Courthouse in Louisiana.
But by bluffing around, he has given Chavis a chance to win, by at least setting the intial venue of the suit. Sure, a Court in Texas may rule that jurisdiction/venue is improper, but can we all agree that LSU didnt have to take that chance?

No way any of this can happen since a gaggle of aTm fans came here and said so....

Chavis named atm to keep venue in Texas district court. If had only named LSU it would have been removed to federal court. Needed a local defendant to defeat diversity

Screw him, that's our (LSU's) money. You can't let someone get away with stealing your money or everyone else will think they can too.
