I think they neighbor who set up the rope should be charged, that could of killed a kid.

quote:

A local teen was taking a short cut while riding his bike in southwest suburban Romeoville when he was knocked to the ground and his throat was cut.

Sergio Perez, 13, said the deep cut across his neck happened after a neighbor used a thin rope to block off a common area behind his home – a rope residents said was put there to keep kids out.
Perez was riding his bike down the hill behind his home Tuesday afternoon when he hit the tight rope.

“Suddenly I felt a pull on my neck because I think I knew that there was going to be a rope on the floor, but I didn't know it was going to be up on the fence,” Perez said.

The rope cut Perez's neck and knocked him out.

This happens more often than it should on bicycle and motorcycle trails.

I'm not saying he shouldn't, but be charged with what exactly?

Doesn't look like it was "slashed." Why was the kid tresspassing? If the land owner didn't have a rope up to keep people out, he would also be liable if someone got hurt on his property and he did nothing to keep people off it.

Yeah the guy that did that should be in trouble b/c that could have killed the kid but, isn't that more of a bad rope burn than a cut? Or am I not seeing it right?

off a common area behind his home

A common area is, in real estate or real property law, the "area which is available for use by more than one person..." The common areas are those "within a building that are available for common use by all tenants, (or) groups of tenants and their invitees."

If anything, charge the kid with trespassing and force him to pay for rope-repair.

I think the guy deserves some kind of punishment from the authorities, I just didn't know what would actually apply.

I don't think you should be charged with anything for putting a rope across your OWN property if it is his. It's not like he rigged a shotgun to blow

Not trespassing if it's not private property

My fault for mis-reading it. If a common area, then yeah the kids parents should sue the guy.

Agreed, they are very painful. I got caught up in a ski rope once and had 2 very similar marks around my waist.

Clearly said "Common Area" on the article I quoted in my OP.

It wasn't exactly a boobie trap. It was a poorly conceived rope fence.
