It was, all the neighbors got together because some of their kids rode back there too. We tried to build a case against the church, but we just couldn't get definitive proof it was them. We knew they were not happy with it and that certain members were hostile to us, but just couldn't get the connection made and the lawyer we were talking with pretty much said we wouldn't get anywhere. I really didn't lose that much money on medical bills and such, no damage to the bike, but I wanted to nail those assholes, just couldn't do it.

Oh yeah. It was just an almost semantics point really. From my understanding the neighbor is liable to some degree. I just also think there's room to doubt that this was actually a "booby trap" with intent to harm. Like I said, it just sounds like a poorly conceived rope fence.

I am not a lawyer but I don't believe you can adjudicate away negligence. Someone could always say it was by mistake they trespassed and should be allowed the benefit of the doubt. The law is very much in favor of innocent until proven guilty. Well that is unless you are in Louisiana.

That was not an attempt to keep people out but to hurt those that rode their bike there.

If you know kids ride bikes there (even if trespassing) and you place a wire at head/neck height, you are at the least negligent and more likely a criminal with intent to cause serious bodily harm. You may remove a trespasser from your property, but you don't get to harm them - unless they refuse to leave. There are all sorts of justifiable forms of trespass; emergencies for instance. Leaving dangerous traps is not the best way to handle it.

Sounds like a lot of people here would be ok with putting land mines or bear traps in their front yard just because it is private property.
