Update on trial date of drunk driver who killed bicyclist

Pretty weak argument, but that's lawyers for you. The guy was wasted out of his mind even if the machine was off. Looks like it'll be till October or later until anything is made of this.

I dont' know much about the legal system so I have a question.

-Let's say the defense/jury are convinced the bicyclists were super high and driving all in teh road
-Let's say the defense/jury buys that this mobile BAC testing Van is not legit, and possibly even throws out whatever the BAC was found to be

Basically, let's assume that everything the defense tries to do is successful, a grand slam. The fact still is this guy ran over 2 people and killed one...so my question is what is the absolute minimum punishment he could receive?

Ok, I'll play along..,

If the jury believes everything the defense says, he'll get off. If they believe the bicyclists were high, and the driver wasn't, it could be pretty easy to convince the jury that the bicyclists caused the accident by swerving as the car was legally passing.

But I don't see how that's going to happen.

If the driver was sober and the cyclists were under the influence, it would matter. Since the driver was drunk, it doesn't matter what the cyclists were on...saw this same attempt at a defense in a North Louisiana drunk driving case.

Driver wasnt just drunk but had an astronomical BAC and was a repeat offender.
