Why Must You Tell A Cop If You Have A Gun In The Car? Isn't A Search Warrant Required?

Whether a person has a gun or not should not be the business of anybody, including a cop, unless a crime has been committed, right? After all, the right to bear arms shall not be infringed.

I agree with your overall sentiment, but I've seen too many videos of police officers getting shot during traffic stops to believe they shouldn't ask this question.

"Under South Carolina's 2024 Constitutional Carry law, you do not have a legal duty to inform law enforcement that you are carrying a firearm, either openly or concealed, during a traffic stop. The previous requirement for Concealed Weapon Permit (CWP) holders to notify officers is no longer applicable."

Why does a cop need a search warrant to ask a question? It’s not a search and you have the right not to answer

In South Carolina you used to have to tell them but you don’t now.

Was it on body cam that he said he had weapons?It’s a he said/he said situation otherwise. That article is poorly written btw.

But I also agree with your OP actually. Is it law that you must disclose you have a weapon?

I know I’m not a wanted criminal. I’m just doing what I feel like will put the LEO at ease and get me on my way faster. A traffic stop is not the fight for personal freedoms I’m gonna put time and energy into, it is what is.

It's either a God given right or it ain't. Which one is it? If it's a God given right, what busienss is if of the government? The ENTIRE reason for the Revolution was to limit government. And the "I've seen too many videos" - how many interactions where nothing happened have you seen?

None.

It's either a God given right that is none of your business (and you are the authoritarian government that the 2nd amendment is aimed at), or it isn't.

I'm required to disclose it if I'm concealed carrying.

But if it's in the door pocket or under the seat I am not.

Not in Missouri but its a courtesy, I have offered, when stopped for traffic offences.

Windows down. Credentials ready. On my way in less than 10 mins. Usually with a warning.

I pick and choose what at the time is best me and mine. I’m sorry that I don’t see arguing and debating with a random police officer as a righteous cause. My fellow Americans can choose to do whatever the frick they want.

I guess I fail to see why it’s a problem. If youre not a threat why not at least have the officer relax. Hell, it may be a simple gesture that gets a violation turned into just a warning. If cops aren’t dicks to me I see no reason to be one to them.

Although you make great points on the flip side what if they enter gun info in their database about the stop? If they note you had a gun (even legally) the next cop stops you and approaches things differently.

Its never good for any government to have gun info on citizens.

Just my 2 cents. I have no idea if they log gun info but it could be done easily.
