What should happen to this guy in the country illegally

He was born in NZ and raised in Australia

Came to the US in his late teens, overstayed his visa and was recruited into the Marines during the Gulf War.

Says that he was promised automatic citizenship if honorably discharged and left the Marines thinking he was a citizen.

Lived in Florida, got a drivers license and voted in elections. Voting illegally made things worse for him with the courts.

Then 5 years ago (not sure) went to renew his license and was told he was not a citizen.

Turns out that he didn't enter duty in the Selective Reserve until 2 weeks after hostilities officially ended so didn't qualify for the program that granted citizenship for illegals serving during wartime.

Now he's lost his final federal court battle, has no citizenship anywhere because he lost that in Australia when he enlisted, and will be deported somewhere unless Trump helps him personally. He petitioned Biden but never heard back.

It's not a Trump immigration thing, he would have still probably been in the same boat under Biden.

If you honorably serve in the US military, you should be a citizen. You're already more patriotic than 90% of the country.

That's a crazy situation to be in.

I'm in favor of granting him citizenship if he's a good "citizen". He sounds like a decent guy.

Just my opinion, but if you are a non-citizen that serves in our military, once you receive your honorable discharge it should come with citizenship attached to it.

That's not a failure on his part, that's a failure of the US government in not keeping their word, or at least not notifying him of the policy change in time.



Citizenship should be granted and made retroactive to the point of his Honorable Discharge.

I am OK with him becoming a citizen, however his lack effort verifying gives me pause to care about his outcome.

Stupidity is not a defense, citizenship comes with paperwork. It is not very complicated to know if you are a citizen.

I think Trump administration should push this through if no questionable legal happenings in his past.

That sounds completely like someone with authority to can provide an exception for based on circumstances.

So either the current admin is a dick or maybe there is more to this story?

Ok, but what this approach and any other that says "if x/y/z conditions are met, you get to be a citizen" does is keeps an incentive in place for illegals to continue coming here.

There should be ZERO incentive for illegals to come here and they will stop. Also not sure I'd want a bunch of third world non-citizens flooding our military. They need to be told/incentivized to stay in their country and make it less of a shithole. Join their own military.

I'm not sure I follow how this would work. Please provide a scenario.

ETA: A non-citizen living elsewhere joining our military would be a mercenary.

Go to the US embassy or military base in their country. Say, "I want to be in the Army, Navy, Air Force Marines." The two parties work up a contract if they can meet the requirements (Physically fit. Of service age 17-42. They can speak English. And can obtain a SSN and a green card). They come to the US for basic training. Complete their service. Become a Citizen.

My personal thoughts is that obviously this is someone that should have leniency, but as a broader policy matter why does he get a pass when others don't? Hard to go fully in on the SAVE act and then turn around and assist someone who voted illegally. There's also many other stories of veterans being deported too, I've had some as clients, it's not some never before seen scenario.

I'm a firm believer that if you come and serve for this country you should be given a very direct pathway to citizenship. In peace or war time.
