The decision in USPS v. Konan reverses a lower court, confirming that the Postal Service's exemption covers even deliberate misconduct, shielding it from a "flood of similar lawsuits" that could arise from its daily operations

Justice Clarence Thomas, writing for a majority of five conservative justices, said the federal law that generally shields the Postal Service from lawsuits over missing, lost and undelivered mail includes “the intentional nondelivery of mail.”

In dissent, Justice Sonia Sotomayor wrote that while the protection against lawsuits is broad, it does not extend to situations when the decision not to deliver mail “was driven by malicious reasons.” Justice Neil Gorsuch joined his three liberal colleagues in dissent.

I'd say don't give them any ideas but that has already happened and now they can't be sued for it. This is why mail in ballots will be limited in the next election.

Sovereign immunity is the default setting for all governments.

This isn't surprising.


But it begs the question about why anyone should trust the post office with a ballot.

a. Really bad weather.
b. It's close to quiting time.
c. I don't feel like delivering mail today.

so, this is an extraordinarily rare situation where I find myself in agreement with the liberal minority on the court

why the hell would:

and since this is excluded from lawsuits; what recourse is there in this situation?

I never thought this day would come, I never even dreamed it was possible. In this case I find that I am in complete disagreement with Clarence Thomas and in full agreement with Justice Wise Latina.

What's next? Will up suddenly become down? Will water cease being wet?



I need someone to tell me this was really from the Babylon Bee.

Mail wasn't delivered here last saturday... postal workers were holding a rally for "higher wages, improved benefits, and safer working conditions." They are union. Why should the govt fund them? Over the last couple of years, there have been more days that mail isn't delivered and it's not because of inclement weather.

USPS sucks in every way imaginable.


It is the epitome of how much anything touched or run by Government sucks.


It has rivals, of course…. SSA, VA, DMV, and hundreds, if not thousands, of NGOs.

The specifics of what started this case need to be addressed.

An apartment complex had a broken master lock on a set of mailboxes. The property manager (who did not live there herself) refused to fix the lock. Instead she insisted that the mail for all residents of that complex be given to her and she would distribute it. The post office told her to pound sand and changed the lock.

Let me ask you, would you want a landlord or anyone else going through your mail? Probably not. The property manager sued the post office claiming racism. That’s the gist of where this originated from but it gets glossed over in all media reports of this case.

I wouldn't want anyone going through my mail and the landlady pulled the racist card...that alone sent up red flags but if mail carriers believe they no longer have to deliver mail according to schedule after this ruling is concerning. The postmaster said that 50% quit their jobs in the first year.
