NEW ORLEANS —
Former New Orleans Mayor LaToya Cantrell has decided to cash out her pension.

According to records obtained by WDSU, instead of receiving monthly payments from her pension when she turns 65, Cantrell has opted to receive a lump-sum payout.

Had she opted to receive payments at the state retirement age of 65, she would not get her pension until 2037, and it would be around $3,000 a month for the eight years she served as mayor.

Cantrell, who is facing federal criminal charges, could lose her entire pension benefit if convicted or if she pleads guilty to the charges she is facing, which include wire fraud, making false statements, obstruction of justice and false declaration before a grand jury.

Cantrell has plead not guilty.

Her pension benefits are based off her highest salary as mayor. She made almost $200,000 when she left office earlier this month.

Cantrell will not get a full payment. She is required to withhold 20% of her pension for tax purposes.

Probably why she's cashing it in before she goes to prison. She sees the future.

If the new administration had a backbone, they’d deny payment under a reservation of rights based upon Cantrell’s pending criminal charges as a basis for outright denial of pension.

Do the taxpayers get refunded the $69k if she’s convicted?

If so, good luck with that.

Yes, but it’d still require a hearing to evaluate the nature of the offense and any mitigating factors to consider. Basically another layer for the judge to lessen the forfeiture penalty amount.

Assuming city successfully gets past that stage, then the city would have to initiate garnishment/seizure proceedings, which knowing Destroya she’d have herself robed in multiple layers of fraud insulating her from liquidity.

She's clearly trying to build up a war chest to fight her prison sentence. Phase ta-2 bitch can rot and I wish she could take Avegno's psycho arse with her.

2037-2026=11
65-11 =54

Damn that's a rough 54.

Which shows you a lovely little loophole written into the law by the criminal legislators under the guise of fighting corruption...see also the ridiculous thresholds required for a recall effort

If you are under indictment, the lump sum pension payment should not be an option to avoid potential pension forfeiture.

I thought it would be more than that.

She's withdrawing at 54. There are huge taxes and penalties for early withdrawal.

That lump sum payment is the contributions that she paid into the system. Not free money. That's funds that were withheld from her paycheck. Since the system will not pay her in the future, she is entitled to withdraw the funds she paid in. The article is very poorly written.
