Man charged with murder after he shot and killed an armed home intruder

Weird story... a man in Texas killed an armed intruder in his home... but is being charged with murder.

How is this possible?

The Big Spring Police Department said it responded to the shooting Friday night. Responding officers found Joel Adrian Florez, 43, and a 40-year-old woman standing outside the home.

If you cant shoot people in Texas, where can you shoot em? There has to be a whole lot more to the story.

Considering that Texas has among the most robust self-defense statutes in the nation, my guess is that the media is being willfully ignorant of whatever major glaring fricking issue is in the arrest warrant that would mean that this wouldn't turn into a national ragebait news story.

Sounds like bullshite!

Now this guy is going to have to hire a Lawyer. And go broke. All to prove his innocence.

Also wouldn't matter. In both Texas and Louisiana, if someone is actively prowling in your home, you don't have to give them a sporting chance in turning around.

Or the homeowner is a felon maybe? Not sure how far that plays into a self defense case.

If you c/p the first paragraph into google, you'll see a dozen different locals news affiliates all running the identical short story. Pretty standard for local TV news affiliates these days, unfortunately.

It doesn't. He could potentially be charged with felon in possession, but his status as a felon wouldn't justify being charged with murder if it would otherwise be legitimate self defense or defense of property.

Detectives obtained a murder warrant for Florez. He was arrested on Saturday and booked into the Howard County Detention Center.

It’s unclear whether Florez and Lozano knew each other.

I don't think that would be a murder charge though if it were an otherwise legal shoot? Just a "felon in illegal possession of a firearm" charge

In that case he would only be charged with felon in possession, not murder.

Assuming “armed home intruder” is accurate, it’ll take some interesting facts to support the charge in Texas.

Something like “homeowner imprisons and starves armed home intruder for three weeks before killing him”

Or “armed home intruder killed by kidnapper when attempting to rescue his kidnapped daughter”

Phillip Samuel Lozano was banging his ole lady, when he tried to jump out of the window he was shot in the arse, then fell back in the home.
