Maybe the police didn't believe it was a break-in. Maybe the guy shot someone who was in the house and now says it was a break-in.

With no facts, that is my only guess why he would be charged in Texas.

You guys are just arguing semantics. You still have to go to court and face prosecution and face your accusers, the state.

The Texas jury will most likely side with the guy if it was just a home invasion and he shot him.



If I am the prosecution i may ask these questions. You are still defending yourself in this case trying to prove you are innocent. Let's not do the dumb semantics argument.



Was he actively moving toward you?

Was the gun in his hand or just present?

Was he searching, fleeing, or distracted?

Did you fire the moment you saw him, or later?

Did he have time or opportunity to comply or retreat?




They are trying to convince the jury you are guilty. You are trying to have the jury say you are not guilty.

It’s probably another laying in wait case.

You can’t leave a pile of cash on your table with the blinds up and lights on and hide in the closet with a cannon waiting for your crack head neighbor to jimmy the door.

I haven’t read all of this yet. But there must be something else going on. Like did he know the guy and they got in some kind of argument? Did he lure him in? This just isn’t adding up in Texas. He’s got every right to shoot his arse.

Yup. I’ve seen multiple cases in which a kid selling drugs legitimately (you know what I mean…) was straight up armed robbed, killed the would be robber, and then got indicted for murder because he couldn’t claim self defense.

The shooting occurred late Friday, but I am not sure when arrest took place. It seems like it happened later. Only thing that would make sense is that they discovered an inconsistency after initial reports that might put doubt into break in aspect or maybe where the guy was actually shot which could change initial thinking it was self defense like the guy said. Not sure why they wouldn’t say this, but if evidence is weak they might be hoping the woman admits the truth after arresting the guy and getting him away from her.

I don't care. If they proved the guy broke into the man's home, he's justified. I don't care what other stuff happened.

Saw a comment elsewhere that it wasn’t his home, and he was called there after the “intruder” was already there
