If Halligan is disqualified that simply means next man/woman up. That doesn't dismiss the indictment.

It is simply stated in the link. Regardless, eventually Letitia James and James Comey will be prosecuted for their criminal activity.

Judges have declined to dismiss indictments for other "improper" appointees (see Habba decisions).

They may be able to get her barred from trying the the cases, but they won't be dismissed.

It will go something like this....

They did not charge schiff for the same thing so its targeting me. The judge will agree and dismiss.

Then schiff will be charged and he will say, they dismissed her for the same thing, mine should be dismissed, and the judge will agree.

Not a big deal. If judge is going to approve or deny on same issue, wants to be done with it at once.

Seems the last thing they should want is to have Halligan removed from the case. They should be seeking an Order that Halligan must try the case. That gives the defendants the absolute best chance of winning.

I could be wrong, but there seems to be an enormous difference in the potential CONSEQUENCES of granting these motions.

If the disqualification is granted in the Comey case, that will end it. A defective indictment doesn't stop the statute of limitations from running. The only charges against Comey (so far) occurred more than 5 years ago.

That's not true with James. Even if Halligan isn't the lawful US Attorney for EDVA, another prosecutor can start fresh against James.

Which is why I am so confused. You would think they would want to try this in front of Cannon to erase any doubt among so many others.

I'm pretty sure you're right. I haven't looked at the dates but I think she's well within the SOL.

It would be egg on the face of the admin if they bumbled this easy indictment for Comey, though. Just typical Trump admin chaos.
