People that lawyer up for DWI?

Honest question as I have a nephew going through this, and yes he’s a loser. Has a tattoo. People that don’t blow and lawyer up…what are the odds of them getting off?
I’m sure they spend a fortune, but is it probable they don’t get a charge? My sister keeps swearing he’s a good kid, but I want him to pay the price. He refused to blow and didn’t do their circus act test.

Still gonna get an 1 year suspended license regardless.
Unless the lawyer can find a reason that can get it dropped, he is still gonna have to do the pre trial program to get it dropped.
Basically, even if he refused everything, unless there is a reason for it to be dropped, he is gonna have to go through the program and get a breathalyzer in his vehicle

Likely get the same deal as anyone else with a first time offense. PTI, maybe some limits on license. Can possibly stay off record if no subsequent DWI offenses.
Now if you go for the deluxe package, you drop some coin to the DA’s campaign fund or through your attorney and get the cop to not show up or some other issue with the case and the judge is forced to drop the case due to lack of evidence, that will cost you.

Hes smarter than you. Its none of your business. Family was a defense attorney and you can't imagine the lies they tell for arrests.

When you blow, you sign your own death warrant.
Not sure where you are but in TX during holiday weekends, they'll take your blood with a warrant at the police station.

That also depends on jurisdiction too.
Some parishes have no refusal rules that will call up a judge in the middle of the night for a warrant for a blood test.

Conviction? Depends a ton on who the Judge is for conviction for 1st Offense and no jury trial.
As for being charged at all? Depends a ton on who the DA is and who the lawyer is.

At the hospital in emergency room, it appears hospital does not charge for service and the state pays for testing.

A tattoo has nothing to do with his refusal to blow.
Any attorney out there will tell you to refuse and deal with the license suspension.

That’s incorrect. There is a hearing before they can do that. Even if you do blow, they can give you 6 months suspension. Either way you apply to get a hardship license. It’s a civil matter and not a criminal matter when they try to suspend your license.

In Louisiana you can or could go to court alone, plead guilty and ask to be sentenced under Article 894.
It's a slap on the wrist but you have to stay out of trouble for a year, do community service, alcohol classes and pay the fine.
But it will not go on your public record or insurance.
