LANSING, Mich. (FOX 2) - Michigan lawmakers proposed a bill last week banning porn.
quote:
This comes after the bill's primary sponsor, Rep. Josh Schriver (R-Oxford), said earlier this year that he was working to draft legislation banning all porn online. Dig deeper: House Bill 4938, called the "Anticorruption of Public Morals Act," would prohibit the distribution of "real, animated, digitally generated, written, or auditory" depictions of sexual acts. The bill breaks down the types of acts covered, including intercourse and masturbation.
quote:
The bill also includes a section that takes aim at transgender individuals by prohibiting material "that includes a disconnection between biology and gender by an individual of 1 biological sex imitating, depicting, or representing himself or herself to be of the other biological sex."
quote:
If the bill were to become law, violators could be looking at prison time or hefty fines. Distributing the prohibited material or making it available online would carry a maximum prison sentence of 20 years and/or a $100,000 fine. If more than 100 pieces of prohibited material are involved, that penalty jumps to 25 years in prison and/or a fine up to $125,000.

No way in hell this passes in Michigan. This probably couldn't be passed anywhere in the US.

Not only will it not pass, but would be struck down by the courts if it did.

Stretching Gretchen isn’t going to support this

Flash forward; there's a sudden and extreme demand for vintage Victoria's Secret catalogs in Michigan.

I mean they wouldn’t be allowed to show most mainstream movies.
I get that it’s not ideal for developing minds to have unlimited access to depravity but maybe there’s some middle ground somewhere.

I could be wrong but didn’t Larry Flynt win a lawsuit that prevented this?

Free and unfettered access to porn (and gore) will ultimately destroy our civilization.

Hustler Magazine v. Falwell was a libel case about parody. Which protected parody under the first amendment. Hustler did a parody of Jerry Falwell and he sued and won damages. It went to the supreme court and Falwell lost.
Cincinnati v. Contemporary Arts Center, (Robert Mapplethorpe case) might actually be the one that covers this, it was an obscenity case where the artistic value of pornographic images were upheld. I don't really remember all the details of this case specifically, but it seems in the ballpark.
Stanley v. Georgia (paraphrasing here) allows you to legally have pornographic material in your home.

That would be devastating to Alabama's favorite coping mechanism. The Deboer years about to get doubly difficult.

This is just posturing because this would be deemed unconstitutional almost immediately.
Now they can enact a law like Louisiana, Texas, and others that require confirmed ID to access, but they can't outright ban it.

What is the purpose of this?
A 20 year prison sentence for porn?
At best it’s a gross overreaction.
At worst it’s propaganda for the left to use to drive independents back to the DNC.
Can’t help but feel this is like Graham going after abortions right before midterms a few years ago… seems like something someone who is trying to get democrats elected would do.

This will be a thing in the coming years because now you can make homemade porn with a Localized AI Image/Video generator. Politicians with skin in the game will push for the ban to grow an AI market they invested in.
