Nevada high court sides with Jon Gruden in lawsuit over NFL emails

In their 5-2 ruling, justices did not determine whether or not the league had leaked Gruden's emails, but they found that the league's decision to force his complaint into arbitration proceedings overseen by NFL commissioner Roger Goodell -- the target of Gruden's civil lawsuit -- was "unconscionable."
As a former employee, Gruden should not have been bound by a provision in the NFL Constitution mandating arbitration for such complaints, the court ruled.
"By its own unambiguous language, the NFL Constitution no longer applies to Gruden," the justices wrote. "If the NFL Constitution were to bind former employees, the Commissioner could essentially pick and choose which disputes to arbitrate."
All seven justices reconsidered the findings after a smaller panel of the court last year split 2-1 decision to dismiss Gruden's civil case. The same three justices on July 1, 2024 rejected, by the same 2-1 margin, a request from Gruden's attorneys to reconsider.
"We're very pleased with the Nevada Supreme Court's decision, not just for Coach Gruden but for all employees facing an employer's unfair arbitration process," said Adam Hosmer-Henner of McDonald Carano LLP, attorneys for Jon Gruden. "This victory further vindicates Coach Gruden's reputation, and it clears the way to swiftly bringing him full justice and holding the NFL accountable."
The NFL's only remaining avenue would be an appeal to the U.S. Supreme Court. An NFL spokesman declined to comment.

The NFL completely orchestrated the entire thing to torpedo Gruden and everyone knows it, it's why they are desperately trying to avoid discovery in court.

This suit seems to scream for a settlement but that may depend on just how bad Gruden wants to embarrass Goodell.

Gruden won't settle. They could offer him $500M and he won't settle.
This is about vengeance.

I don't think Gruden holds Davis in any disregard. He's knows he's in over his head and Jon still speaks kindly about the organization. He just hates Goodell with a passion.

I agree that the NFL targeted Gruden. What I don't remember from the incident is why did they want him out so bad? Gruden seems to be universally liked, and is a great ambassador for football, so why did the NFL torpedo him?

I haven't followed this too closely, why did Goodell go after Gruden?

I've always thought the owners leaked the emails. IIRC, there was chatter about the players replacing De Smith as the head of the NFLPA and the owners didn't want that because they routinely bent him over a barrel at the negotiating table.
Owners leaked the emails to make it a PR nightmare to remove Smith and Gruden just happened to be collateral damage.

Theyll bend over any NFLPA head at that table due to the nature of the NFL and the differences between owners and players… Owners weren’t always billionaires (even adjusting for inflation) back in the day. Players need football way more than them. Theyll take anything to keep their spot and not miss a paycheck

Agreed...frick settlement UNLESS it stipulates the Goodell has to step down. That cocksucker fricked the Saints around the same time because the NFL can't have small market teams dominate, if they can stop it
