A judge has ordered that Mohsen Mahdawi, the Columbia University student who was arrested two weeks ago by Immigration and Customs Enforcement agents following his citizenship interview, be released from detention while his case proceeds.

"The two weeks of detention so far demonstrate great harm to a person who has been charged with no crime," U.S. District Judge Geoffrey Crawford said at a hearing Wednesday. "Mr. Mahdawi, I will order you released."

can someone explain the whole judge thing? I don't understand how these cases even get to them? can they unilaterally change rulings regarding any federal issue in any district or jurisdiction? are they just watching the interwebz for stories that they can improperly insert themselves into? is that how they get these cases?

dems have no power right now in government so they have weaponized the entire legal system and go after every single thing trump does w/ some kind of trumped up crisis to get emergency stays for everything from cutting fraudulent payments to ordering the return of terrorists from foreign countries.

Huh? The history of litigating our government and hanging up everything the government does in court goes back a long ways. Are you familiar with naders raiders?

It seems like one of these cases, at least, is going to address the limits - if any - of free speech that foreign nationals/green card holders have.

Don't shoot the messenger. I'm just answering the question.

These cases get to judges because someone files a habeas corpus petition in that judge's court. The petition alleges that their detention is unlawful.

The judges don't just invent cases. They only call balls and strikes on what is pitched to them. NOW, I am not saying they rule fairly. AND, at least in one case that was filed and ruled on after office hours, I think there might have been collusion between the plaintiff and the judge.

Trump’s second term, though only three months in, is already facing legal challenges (205–207 cases, 15 injunctions) at a rate surpassing Biden (133 cases, 14 injunctions), Obama (30–50 cases, 12 injunctions), and Bush (10–20 cases, 6 injunctions) over their full terms. His first term (266 cases, 64 injunctions) remains the high-water mark for legal opposition.
