What if a pregnant Canadian, European, or Asian tourist is on vacation in the U.S....

and they happen to go into labor.... will their child automatically become a U.S. citizen?

If not, why do illegals get a pass?

As I understand it...if you're born here you're a citizen.

With the exception of your mother being here as some outside occupying force (think war) or here as a diplomat who is here with diplomatic immunity.

Go spend some time in Miami and you'll see a ton of pregnant eastern euro chicks, mostly russian. Where i stay in miami, there are more russians than cubans.

There’s an entire travel industry built around Chinese people getting setup to have their baby here for birth certificate purposes.

My ex GF was born in Germany, daughter of a US soldier and a German national. According to German law, at age 18, she had to pick one or the other.
We need a similar law.

That’s where the whole jurisdiction argument comes in. The argument is that those parents fall under their countries jurisdiction so no the newborn isn’t a citizen. Same as illegals.

The confusion is the 1890s USSC tried a case of a man born here from immigrants. But there is an argument now there also as his parents had lived here for years as did he. They were Chinese and at the time, Chinese immigrants were viewed as inferior and undesirable so citizenship was hard to come by. Edited to add, I’m not sure what the legal immigration status of the parents but given the times, it’s likely they were here legal.

I’m no legal scholar and I am not looking up all these papers and reports but common sense would seem, to me, be on Trumps side. Anchor babies aren’t good for a country as it is a loophole in a legal immigration process and it’s why 70% of the world doesn’t allow it.

There is an entire industry based on people from foreign contrives traveling to the US on "vacation" just to give birth for the purpose of their child having US citizenship. Asian countries have travel agencies set up solely for this purpose.

Yes. Well documented China had flights full of pregnant women coming to US just for childbirth.

My daughter was born in France. She has dual but, I agree.

The bottom line is the 14th amendment is being abused. Because we are generally nice and gave an inch and didn't see a big deal with birth right citizenship the communists Democrats have taken a mile. They want to use immigration policy to replace Americans of mostly European decent and some American males of African decent with people that will vote for them in elections.

Ones taking advantage of what is a perceived loophole in our Constitution, thanks to the current malinterpretation of the 14th Amendment.

The birth tourism industry is MASSIVE, particularly from Asian countries into sympathetic western states like CA, OR & WA.

There is a term for this because it's an actual business. You pay a company to get your visa right before giving birth and voila - US citizen baby. "Birth tourism" or something.

No one should be able to do that.
