No. The parents are under the jurisdiction of their country of origin. Illegals fall under that same category and is how SCOTUS will rule once this makes it to that level.

There is an entire industry engaged in pregnancy tourism to the US. The Russians in particular were reportedly using Trump owned condos in Miami as hotels for birthing foreigners.

Dual citizenship is a weird situation. My good friend married a Canadian girl he met in law school. However her parents are 2nd generation Italian Canadians so she was already a dual Canadian-Italian and after they were married she kept the Canadian-Italian citizenship and got the proper documents to work in the US as a lawyer. I tried asking my buddy and he said its so complex it even confuses him.

More than you think. A lot of wealthy russians go to Miami for birth so their kid has dual citizenship. I think this is all BS and you should have to apply for birthright citizenship 90 days prior, in person, and show you have a legal status or something similar.

Yes. Extremely common.
Someone could be flying from Brazil to Canada and go into labor on a layover in O'Hare and the kid is a U.S. Citizen. Completely ridiculous.

How many viable births happen in the 6th and 7th month of pregnancy? I agree, I don't believe too many women would plan a vacation at week 35-36 of a pregnancy, but it is still a valid question.

My son was born in Germany when I was serving in the Army but the decision on citizenship had to be made immediately if I remember correctly…
