Guy on twitter legitimately lost more than $60 million a couple of weeks ago on a pharma company he was long on after their drug failed a clinical trial.
He had been the biggest cheerleader of the drug beforehand even though the scientist behind it had been indicted by the feds for research fraud. The company had attracted a cult following that was convinced they were sticking it to big pharma by investing.

I am pretty sure he understands they won't be getting an indemnity check from the IRS but the other party with the realized STCG will be stroking him a check for an agreed upon percentage of the money they save on the taxes due on their STCG.
This is an individual variation of something companies have done for years but they often aren't planning an immediate diverse afterwards.
