It's a legal proceeding. I'd expect my lawyer to use whatever tactic he can to limit my exposure. I don't want him tossing out potentially good arguments because "that sounds too mean." If there's an argument to be made that the victim didn't do what was necessary and reasonable, and that's not my fault, it needs to be made.

Even if they win this case, that is going to be the PR nightmare of all time for them.

There is no doubt that this is is a heinous act by the flight attendant.

Would or should a 14 year old have known that the setup pictured above was an iPhone taped to a toilet lid? Probably. You can clearly see what appears to be an iPhone under the tape.

Accordingly, does that 14 year old have some responsibility to not just ignore the iPhone and use the bathroom anyway? Probably.

Would your answer change if it was a 9 year old?

Would or should a 9 year old have known that the setup pictured above was an iPhone taped to a toilet lid? Maybe. Probably?

At what age should a child know that the setup was an iPhone and not use that bathroom?

In any event, the issue of whether to raise that possible defense should have been discussed with AA by the attorney prior to filing the answer.

This is believable to be honest. The cretin drones that the airlines and their insurance carriers hire are exactly the type of people who would make that argument.

Lawyer here. It’s malpractice not to include an affirmative defense of contributory fault. But I can’t imagine making this affirmative defense without hard information to back it up:

If anyone on my team made that defense they had better have some real facts to support it. If they just threw it out there without something to back it up, I’d have that attorney’s stuff packed in a box and waiting on the curb for pick up. Believe it or not, some of us aren’t soulless.

No matter the age, NO ONE should expect this to be a possibility. No excuse at all. Lawyers really are scum if they believe this was a legit argument. Not even a "throw at the wall to see what sticks" argument.
