Much like Michael Cohen’s testimony, they are largely making it up as they go along.

We have to remember in their eyes, Trump has always been guilty.

They just have to find something to attach it to.

ha...this is 100% false. The charged crime is falsification of business records. That misdemeanor crime has extinguished per the statute of limitations. So, Bragg is attempting to revive that crime as a felony by claiming the falsification of business records happened in furtherance of another crime.

That’s not relevant.

To point to a crime you actually have to have a crime. So either he’s already convicted of said underlying crime (he’s not) or he’s being charged with one in this case (he’s not).

This trial violates the most basic rules of law there are. It’s how you know the judge is involved.

It’s not. It’s way worse.

They have to point to a crime (found guilty) not a charge of a crime. He hasn’t been found guilty.

They aren’t charging him with an underlying crime. That is what’s required of the charges they put forth.

it's not being tried as a state crime. There is only one crime being pursued. Falsification of business records.

The rest is just a procedural mechanism that would allow them to move from misdemeanor falsification of business records to felony falsification of business records.
