this guy looks to be pretty safe, because the statute in Texas is written that way. The guy up in New York was facing potential problems, because the New York statute was written quite differently.

personally, I hope that both of those New York situations work out in favor of the defendant. Morally, I think the defendant was right in both cases. That belief, however, does not change the crappy New York statute and the way it exposes good samaritans to potential prosecution.

- Owner attempts to hold thief until the police arrive to deal with the theft
- Thief pulls a gun on the owner of the vehicle, shoots owner
- Owner returns fire and ultimately shoots and kills thief
- Thief’s brother wrongly accuses owner of being a vigilante

Well, the thief is dead, so shipping his corpse to Mexico would be a bit pointless.

Do you have some evidence that either the thief OR his brother would have been subject to deportation? That they are Latino, in a city that is 66% Latino?

I've seen signs, typically at independently owned commercial buildings (garages, etc) that say "Nothing in here is worth dying for."

Having said that, had this happened in a lot of states the owner would be screwed.

ALL of this could’ve been avoided had they not CHOSEN to steal a vehicle.

Sometimes it seems like the very basics get overlooked by this family and others.
