Imo I believe you have to give the benefit of the doubt to any President and former President when it comes to whether or not material is classified. The law clearly gives the President the authority to declassify anything for any reason, however he chooses to do it. You can’t make the argument he didn’t declassify it when classification is completely within his discretion. The problem with this indictment is that it’s trying to create a standard of presidential declassification where none legally exists. Like the standard of presumption of innocent until proven guilty, you have to have the presumption that any document in possession of a President or former president is declassified when in his possession unless you can prove that he broke into the archive and stole it after his presidency or was part of a conspiracy to unlawfully obtain the document
First of all….I disagree that we should give the benefit of the doubt to a politician…..for fricking any reason.
Second. Apparently Trump, himself, stated that the documents were not declassified. That completely throws out an presumption

This is not related to Crossfire Hurricane.
What war was he providing our "plan of attack" for?

Is there any evidence that contradicts what’s allegedly on the recording? Has trump denied the recording
Is there evidence on the recording that proves Trump physically opened the folder in front of them and showed the contents? I haven’t seen it yet.
I’ve only heard here-say and saw the word “shows”, which could mean anything. Did he literally open it up and have them look inside? I want to see that proof.

Trump's lawyers just resigned, Bonds. You should make your pitch.

It's not Trump's job to confirm or deny the recording. How would he know if there is a recording or not? It's the DOJ's job to back up their claim that they have a recording and present it to the defense and the court.

Trump will get a chance to tell his side of it.
Lol. The Espionage Act severely limits his ability to present a defense. It's an abomination of a statute used primarily to punish opponents of the Machine.

That would be sufficient but he actually wrote a memorandum. It's been posted here several times.
For Crossfire Hurricane. Not every classified document he took. And it doesn't matter, per espionage act.

fricking when has Trump ever been needed to ask to speak?

Others have mentioned in this thread that retaining information relevant to national security is potentially illegal irrespective of classification. None of this has ever come up in the context of a former president before, so not sure what precedents may not apply.

Which document did he say this about? And who heard him say it?

That was dated January 19. How stupid is Trump...and by extension Trumptards?
Biden was sworn in January 20th. Moron.

Has trump denied ever showing the Iran war docs to his friends?
Has he ever been asked?
He's gonna have the opportunity to be asked under oath.

Fox News was reporting that they resigned because of the location of the trial in Miami.

You’re really doing a bang up job of ignoring key details of what people are posting.
One of which is the fact that the recording was for the guy who was writing a book for trump.

No interest in getting into an arena where the federal government will be weaponized against you simply for your political beliefs. I’m just commenting on how sad it is people who are otherwise intelligent, like you, support the weaponization of government against political opponents.

It’s been posted a few times in this thread. Apparently there is a recording.
And it apparently happened a second time as well.
Once again….Trump has never had a problem going public with denying things. Has he publicly denied those two incidents?

Like the riot they staged on January 6th was an insurrection.

I didn’t say any politician. I said the President. There is a huge difference. And my argument still stands. If the president can declassify any document in any manner he chooses that means there is no legal standard to charge him with a crime. If I say parkReb you have the absolute authority in matter X and you have the power to choose whatever means you wish to exercise that authority, that means that some Jack arse with a hard on for you can’t come behind you and put you in jail because you didn’t follow a standard. As President, you are literally the standard.
