The Virginia school district where a 6-year-old boy shot a teacher earlier this year is arguing that she should receive workers compensation for her injuries instead of the $40 million she is seeking in a lawsuit.

Abigail Zwerner, 25, was reading to her first-grade class at Richneck Elementary on Jan. 6 when one of her students with a history of behavioral challenges and violence pulled out a gun and shot her in the hand and chest with a single bullet.

Her lawsuit accuses the school district of gross negligence, according to court filings.

She was hospitalized for almost two weeks and told NBC News last month she was still in shock and still had nightmares about the shooting. The case rattled the military shipbuilding community in coastal Virginia and garnered national debate about gun and school violence.

Zwerner sued the Newport News school district in April, claiming administrators acted negligently when they failed to heed warnings the boy was dangerous and ignored reports on the day of the shooting that he had a gun.

40 million seems like a shoot for the stars and hit the moon scenario, will likely be settled for 1-3 million.

I’m not so sure. School administrators had been warned multiple times that the kid had a gun and sat on their crusty unwashed asses. It’s about as egregious as you can get.

Including the day of the shooting. A teacher at the school told the principal that the kid had a gun in his backpack. Rather than actually checking the kid's backpack, the principal told the teacher that the backpack was too small to hold a gun. I guess it wasn't.

No, those taxpayers deserve to pay $40 million as a lesson for electing dumbshits. Even taxpayers need to be held accountable. She deserves every cent.

Yeah but 40 million?

She is still alive. If she worked 40 years making 50K that's 2 million. So getting shot is worth 20 times a life long wage earnings?

I would be cool with 5 million payout. And whomever was negligent fired.

Who ever heard of a 6-yo brandishing a gun and bringing it to school? Who gave him the gun, and why? A 6-yo can't purchase a firearm legally anywhere in the US.

The teacher has very legitimate claim, and should have a slam dunk with concerns to the lawsuit. I doubt the insurnace company that will be representing the school district will ever allow this to go before a jury. They will settle.

That being said, I do have a problem with the teacher and teachers. Imagine you are teacher of freaking ELEMENTARY students, and you know a FIRST GRADER has a gun in his backpack. Do you really run down to the principal's office to tell, or do you go over to the kid and take the back pack and remove the gun? Seems like all of this would have been avoided if just one responsible adult had took charge with a potential life or death situation.

Sounds to me like the Virginia school board has a very bad lawyer. Black felons who are killed pulling guns on police officers get millions, why shouldn't this lady?

VA school boards think they are above the law.

Loudon County SB sicced the FBI and local cops on parents who brought attention to a girl raped by a trans-identifying male in a school shower and tried to victim-blame.


Same people who insist “no means no” when a woman retroactively changes her mind on sex insist that because the girl had fricked the kid before that it wasn’t rape when she refused to do what he wanted that day and he did so anyway.
