Does the person committing the act have a defense if he too is incompacitated and therefore is not able to know or should know the victim was unable to give consent? are there any criminal defense attorneys in here who can provide the answer?

As far as I am aware, it's still considered rape even if the accused is also under the influence. In this particular case, according to their own statements, they were far less drunk than her even if they were under the influence.

It does. The rape part that is. I said it way earlier in this thread that rapes happen way more than people probably think from the tigerland area. The sad part is the only reason we know about this is because she got hit by a car and killed.

If she didn't get hit, she might not have even remembered or too shy to come forward and these guys would be in the clear to do it again, which they would have.

I hate that I think like an old man now but tigerland is completely out of control. Reggies is probably going the way of the dodo. How many businesses are allowed to operate illegally like they do out in the open? They pay government officials to stay open. It's no secret.

Just once, I'd like to see a prominent black person speak out against this kind of stuff. I'm not talking about someone like Thomas Sowell, because while he is a brilliant man, he doesn't have the ear of young black kids. It's got to be someone like LeBron, Obama, Kaepernick, or any goddamn rapper. But either they don't care enough because the victims are almost always white or Asian, or they support this kind of shite and like seeing it happen. After all, "silence is violence", right?

Many of them have the attitude that "white folks enslaved and raped and murdered black folks for years and nothing was done... now one of their own gets it and they want to get upset? Maybe now you know how it feels." It's all justified in their minds

This thread is full of people making accusations regarding things they're clearly not in the know about so they can pin blame on someone who's not to blame. Rage over underage drinking is a very recent thing. Throughout history, teens drinking has been relatively normalized. Most Karens here wouldn't have survived the 70s or early 80s.

You've got to be one sick frick to actually rape her, but then video yourself being a rapist. That is infuriating in itself.

Sadly this is the truth, and it's certainly not helped by modern news media and politicians that would have you believe the KKK is still active and prevalent.

I asked this same question and you’d thought I’d slapped some posters moms in this thread.

Maybe it had something to do with this statement:

Fact is …many here have some same thing these dudes did but only difference was the girl didn’t get run over and killed.

Tate accomplished what he wanted. We should be debating why Baton Rouge has turned into a shithole and how to fix it and instead he's set the narrative to this.

MS, AL, FL looking like better options for my kids.

when I worked the door and bartended in the 90s we used wrist bands to identify 21 and over - do they not use wrist bands any more?

no wrist band, no buying at the bar. so obviously patrons would send one over 21 person to the bar to buy all the drinks. So you install a 2 drink purchase maximum and that cures a lot of the underage drinking problems. Made it easy for ABC to anonymously monitor underage drinking in a bar, just note everyone drinking from a cup with no wristband and the cases stack up.

Sports/Reggie's got away with a lot simply because they allowed it and it would get so crowded in there it is very difficult to monitor who was drinking what

drinking age was 18 when I started at LSU (Fall of 1990) and changed after I had already turned 21.

The people in the HS class of 1991 got to drink for two years and then couldnt drink until they turned 21 in their 3rd year of college

If you look at what's happened with a lot of European countries in regards to Islamic immigration, their failure to immigrate, and the resulting flux in political power, you could draw a reasonable conclusion that the U.S. is about 20 or so years from electing white nationalists into office.

Frankly, that wouldn't even be close to the worst outcome.

My friend would collect wristbands always have one close enough to match and show up to the bar with cash/tip...bartenders liked the extra cash
