Yes, really.

Even Trump acknowledges this limitation in his 19-Jan-2021 memo

Only if there is a specific law prohibiting it.

And even then, there's a separation of powers issue.

The other part of this that makes no sense is do people really think the former president can just waltz out of the white house with nuclear codes? I understand that is an intentional lie put out there, but people are actually believing it?

several in the Trump camp who claimed to have been there have said this. They suggested a second lock and he agreed to add one. He allegedly told them at the time that they were welcome back anytime to do further review. Remember. This process for going through presidential records post-presidency happens with all presidents.

Said that this was communicated via written correspondence.
So assuming there are offending docs, either the offending docs were planted or the fbi knew they were there and didn’t care to do anything about it for months.
There's not really much else in the way of possible occurrences.
Also Trump’s cooperation with the June doc meeting will make it very difficult to prove “willful.”

I am of the belief that everything was declassified and if not, why the sudden urge to raid when it looks as if President Trump was cooperating with the information requests. Anything outside of the nuclear codes, and this looks bad on the Gestapo FBI and Merrick Garland.

What if Biden re-classified them?

Then it would come down to what Trumps INTENT was.

Thats how it works right? It seemed to for Killary.

So he’ll be convicted?

If he was anyone else he'd be charged, without doubt.(obviously I don't buy the declassification argument)

I read the whole thing as “fbi was aware of everything… normal course of process”. Then a snitch says there’s something in the safe. Search reveals nothing in the safe, but the feds took everything from the 45 room anyway.

There are 3 statutes cited in the warrant.

Does the National Archives have written confirmation or official record the documents were declassified? Were the documents marked as declassified?

We know what Kash Patel says but what about the National Archives? What do they have to say about this? If proper procedures were followed, they would know.

Or is Donald Trump simply claiming they're declassified enough?

I'm gonna keep downvoting you until you learn how to quote who you're replying to. It makes the thread very hard to follow when you post 3-5x a page and don't quote what you're referencing

The more damming claim here is clearly the FBI telling to add an extra lock to the storage area.

Maybe they told him to do that as a quick measure while they took the next 2 months planning how they were going to get back those nuke codes.

I’m hardly DT’s biggest fan, but anybody that takes as credible/factual anything written by DOJ (or pretty much any federal agency) is legit retarded.

Names of spies and nuclear secrets can be declassified?

Yes. The President absolutely can. The authority for national security classifications originates entirely from the Office of the President. While the President can (and does) delegate the authority to others to classify/de-classify information, the President always retains the ultimate authority on this.

So as a result the President has access to all classified information. That doesn’t mean he sees everything or knows about everything, but nothing can be kept from him because it is classified at a level he doesn’t have access to (because such a level cannot exist).

You seem to be confusing the wisdom of declassifying such information with the ability to do so.

Guess what. The documents do not have to be "classified" for there to be a violation of at least two of the cited statutes.

So, if indicted and convicted, he's looking at possibly 10 years or possibly 20 years. At least the jumpsuit will blend right in...

Yes, some democrat just called the Michael Berry show and said Trump stole the codes so he could threaten to launch nukes if they tried to arrest him. Also said Trump is the Antichrist.
