The presumption of innocence is a bedrock principle of our nation’s legal system. That principle is why I filed House Bill 729, which would limit when media outlets can publish booking photos (mugshots) of people who have only been arrested but not yet convicted.
Millions are arrested every year, only to later have their charges dropped or cases dismissed, or be found not guilty. Yet their booking photos, published online or in print, follow them around for years, like a modern-day scarlet letter of criminality.
It is without debate that mugshots are overwhelmingly prejudicial. And while the press might have a First Amendment right to publish the photos, it does not have a First Amendment right to access them.
Fortunately, the tide seems to be turning against these practices. Many media outlets, especially newspapers, have increasingly decided on their own to limit when they publish booking photos, and in many cases have decided to end the practice entirely. And other states have started passing laws to limit their use, including Utah, Florida and Illinois. Now we have an opportunity to do the same here in Louisiana by passing HB 729.

Dumbocrats and the media don’t want people knowing who commits 95% of the crime.
Like the article said it’s why newspapers and news stations have stopped showing mugshots.

I actually believe this is a good law. There are times that people get arrested for things they did not do and have not been found guilty yet. Those pics stay up forever.

Describe the appearance/race all you want, but not fair to publish a person's picture if they haven't even been tried. Unless it's a plea to the public to watch out for a specific person that is at large and believed dangerous.

If you can still see the names it’s all good. Kids around my area were being picked on because of the sins of their parents in school because kids would just look up the mugshots and make T-shirt’s.

That’s good….these websites are just using public data and publishing these photos. I have no problem with the right of the public to know who gets arrested. However, these websites hope to get you to remove the photograph by paying a hefty “administrative fee”.

This flies in the face of a transparent government.
Suppose you are arrested by a truly corrupt system (a Louisiana specialty). They don't give you a phone call and toss your arse in jail. The only information they publish is your name and court date. No photo. Would anybody ever know it was you, especially if you had a common name?

Just show their grade school graduation photos. Or what ever grade they were advanced to before they dropped out.
They could estimate how many dollars the state has saved by not educating the accused after they stopped going to school.

Louisiana politicians know their buddies will prtect them when they get arrested. They're not worried about being convicted, but they have to see their mugshot during every election campaign from that point on. Will they make it a crime to print a politician's old mug shot on campaign literature?

Public shaming is an effective deterrent for many.
STOP cuddling the criminally accused.
Probable cause, although not the highest burden, still suggest that the probabilities that the accused committed the crime are significant enough to allow the photos without reckless defamation.
