BATON ROUGE - A bill that would overhaul Louisiana's punishments for fentanyl possession cleared a major hurdle Tuesday as House lawmakers advanced it to the Senate.
HB90, authored by Rep. John Stefanski, was approved on the House floor, 74-29, and now heads to the Louisiana Senate. The proposal seeks to impose mandatory life sentences for those caught with more than 28 grams, roughly an ounce, of the drug.
Currently, those convicted of possession with intent to distribute fentanyl face a five-year minimum and a 40-year maximum, along with fines up to $50,000. That would now only apply if the offender was caught with less than 28 grams.
The legislative proposal comes amid a wave of high-profile cases that have amplified concerns about the drug statewide, including a rash of deadly overdoses involving small children.
Potential life sentences would be imposed on Fent dealers.

I've seen more fentanyl cases come across my desk in the last six months than I've seen in the previous 15 years combined. It's some nasty shite and everything is getting laced with it. Those who smoke the devil's lettuce need to be on their toes and be careful.

There’s no way I would take anything from a drug dealer. Too much risk now.
Phentanyl ODs need to be called poisoning. These dealers who knowingly sell with that shite in them should be charged with murder.

its a good thing that marijuana bill didnt pass last week.
fun fact: Louisiana has 111 jails or prisons in 64 parishes.

It's a damn shame that you can't even trust your drug dealer anymore.

How often are people caught with 28g of fentanyl? I assume this doesn't apply to large amounts of heroin laced with fentanyl?

The only way to get our Country back is Mandatory Sentences, some Judges do not have the balls to send them up.

Even though he went overboard, the Nathan Millard case in BR should be a constant reminder how deadly the shite is. Gone are the days of doing a few bumps of coke at a college house party, which with some of us that have young kids is scary to think about.

If it doesn't come from a pharmacy or a dispensary, I don't touch it. Fentanyl is in everything now.

they should just legalize it. Problems would work themselves out.

You’d think we’d learn from these mandatory minimums one day. Absolutes dont work with prison sentences or anything in reality.

i guess you feel it would be a shame if there was a legal alternative to the illegal substances ravaging the state?
addicts arent going anywhere. youths with no options turn to whatevers available. maybe you havent paid much attention the last 30 years or so but the war on drugs has been determined and the drugs won.
"throw em in jail." hasnt worked either. the states dirt frickin poor with little to no opportunities.
its a moot point tho. prison/law enforcement lobbies are too big in louisiana for there to be any other outcome. the trend will continue and year after year youll see more and more ODs just like TheFonz said.

They better start building more jails because 28 grams includes fillers, cuts and binders. Think about this…a junkie is busted with 20 pills that contain a total of 10mg of fentanyl but the total weight, including binders, is 40 grams could face the same minimum sentence as an importer that is busted with 28 grams of 99.97% pure fentanyl powder.
There are a *lot* of non-dealer addicts that could get locked up for life.

No we don’t.

Why not make them eat all the fentanyl they are caught with?

bullshite. Even if dealers are lacing weed with fentanyl (they aren’t) lighting it on fire kills the potency. It wouldn’t do anything
