The lawsuit is about money. The HOA wants to charge him for something that is already his right under Florida law. And they are using an HOA statute from 1990 which is now null and void for this situation since the Florida law passed in 2023.

Try living next to someone with no HOA. Loves his stereo, when any of the neighbors are outside he’s fond of cranking it up to nuclear. Couldn’t seem to understand what a property line is either.

Came home from work one day and found he’d dug a trench across my back yard so he could run power to a shop he built. Me and the power company both told him there’s this thing called an easement he’d need and wasn’t going to get so fill it back in.

And before you say “talk to them” shot up his own house as well as went to jail for beating up a girlfriend. Separate times with different women. Some people you just can’t talk to even though all his neighbors tried.

Not that I love them but they do serve a useful purpose in protecting the value of your property.

Much harder to sell a home if your neighbor paints their house purple and installs a trampoline in their front yard.

All HOA disputes should be settled by bare knuckle fighting at the center most point of the neighborhood at high noon on the third Saturday of every month. No rounds, no time limit, last man/woman standing wins.

I view them as a necessary evil in a shared development. The problem is the HOA is run by people with all the flaws and self interest people have no matter what they are in charge of.

Not just that, now they willingly hand control over to a management firm wholly removed from the neighborhood/community with no personal vested interest in it. You live in Louisiana and some jackass in an office in Indiana may be making decisions that directly impact how you and your neighbors (that you're living on top of essentially) get along.

Sounds like the "agreement" between a BR developer and the landscaping company that they tie to the HOA management company where the HOA actually pays for that landscaping company to cut all of the developers lots in the neighborhoods, but they don't replant the trees they're supposed to when they die.

Here's a newer home in downtown Orlando. Do you think it looks trashy? Do you not understand that just because there is no HOA, it doesn't mean people neglect their property? Have you heard of ordinances and code enforcement? The vast majority of people take care of their home because they take pride in it and care about their investment. The same reason most people take a bath and brush their teeth without anyone having to tell them to do it. If dealing with angry Karens and Kens on a weekly basis makes you feel special then that's another matter.

Rules and laws aren’t established to harass the people who do the right thing. They are established for the people that don’t. This veteran simply had to fill out an application for approval but chose to engage in a pissing contest with his HOA. Seems pretty stupid but have at it pal.
