Mine sucks. I wanted to cut down a dead tree on my property that was not a pine tree. Informed the HOA . They took 4 mos. to get back to me and another 45 days to approve it. They also made a new deal with garbage collection. If it isn't in the can they won't pick it up....as per contract. So bags of leaves, you're on your own.

Same. And the can lid has to be closed.

I've gotten handy breaking down limbs into bits with a sawzall.

And they're sueing him despite both a federal and state law that prohibit HOAs banning homeowners from flying the US flag.

Sounds like they will lose that lawsuit and he will likely counter sue for damages and legal fees

When you have several law firms already reaching out to help the veteran, it's a safe assumption that the HOA is in the wrong. Just as state law can't supersede federal law, the HOA doesn't just get to be their own little nation and ignore state law.

Nothing is illegal about storing a boat trailer in your driveway in my town / parish, but our HOA still prohibits it. Its part of the bylaws / rules we agreed to when buying in this neighborhood.

There is a difference between not having a law that disallows something, and a law that expressly allows something.

Pretty sure the flagpole came first...making it more normal.

HOA's are for Karens who shouldnt be living in proximity to other humans and actively seek new levels of government to lord over their lives.

Nerds and geeks, primarily.

HOA has nothing to do with politics, bro.

Yes it does

Its a self imposed level of governent because dipshits think the State/County(Parish)/Federal governments arent oppressive enough.

Fuq HOA’s. I live in an older neighborhood and they tried to get people to voluntarily start one. I was like no fuzzing way you dummies. The guy trying to convince me wound up being pushed to be the “groups” first President. I waited like 3 months and asked how it was going. His reply “man you were right”.

They have some loosely attached name to try and sound official but have no way to enforce anything

I will only live in HOA neighborhoods. Of course, all of the nicer neighborhoods are HOA. The only way I will not is if I move to the country on a plot of land.

This sounds like something SFP would do. I could see him representing the HOA pro bono just so he could argue for hours and hours over this.

We moved to a subdivision 5yrs ago and this is the 1st place we've ever experienced a HOA.
Went to 1 meeting and it was a dick measuring contest sprinkled in with a Karenfest.
I didn't last 10 minutes and never returned.
Anyway, over the 5yrs we've meet alot of the folks and majority (like 99.999%) are Govt employees or retired military and most fly their flags despite it being against HOA rules. We had a few who voiced their displeasure (which alerted many of us of their political view) in meetings (from what i learned from others thru conversations) and even contacted legal reps.
I'll skip to the end result....the anti-flaggers/Americans sold, moved out and replaced with True America Patriots. The HOA is working together like a well oiled machine, getting shite done and things have never been better.
Bottom line- get rid of the detractors on the HOA board who keep you from moving forward.

I looked up the actual statute language. Homeowner stacked, HOA fricked

quote:

(b) Any homeowner may erect a freestanding flagpole no more than 20 feet high on any portion of the homeowner’s real property, regardless of any covenants, restrictions, bylaws, rules, or requirements of the association, if the flagpole does not obstruct sightlines at intersections and is not erected within or upon an easement. The homeowner may further display in a respectful manner from that flagpole, regardless of any covenants, restrictions, bylaws, rules, or requirements of the association, one official United States flag, not larger than 4 1/2 feet by 6 feet, and may additionally display one official flag of the State of Florida or the United States Army, Navy, Air Force, Marines, or Coast Guard, or a POW-MIA flag. Such additional flag must be equal in size to or smaller than the United States flag. The flagpole and display are subject to all building codes, zoning setbacks, and other applicable governmental regulations, including, but not limited to, noise and lighting ordinances in the county or municipality in which the flagpole is erected and all setback and locational criteria contained in the governing documents.

I guess the HOA’s argument is that the fines they levied were due to the homeowner not submitting an application before erecting the flagpole, but counter argument is the law pretty clearly gives the homeowner an absolute right to erect it regardless of what his HOA says

Or, now hear me out. It’s a group of neighborhood homeowners that don’t want their neighborhood turning to shite because trash decided to move in.

What a brilliant take. People who diss putting another level of government in their lives must live in trailer parks.
