100% they would, but those aren't something you can accurately quantify in a settlement negotiation either.

That’s what a quantum report is for. You can absolutely figure out punitive damages with a west law account and an inkling of good lawyering. Funny to see the usual suspects downplaying the settlement.

Look if it comes out that he got over $50m then I will 100% come back and eat crow. I just don't think that is the case.

I'm guessing CNN settled to avoid discovery. The other media outlets might do the same.

They could fight it in court and maybe even win, defamation is typically very difficult to prove, however the internal emails and memos and stuff regarding the story might be more damaging to their reputations than a settlement.

The enemies of America march in Tehran and they also sit in conference rooms at CNN HQ and the Washington Post.

Meh...media hasn't changed much except it's even more left wing but social media has certainly changed things.

Still somewhat the same premise and it was arguably worse for Jewel because of accusation.

I would guess the settlement is in the 10 to $15 million and I thought Richard Jewel's settlement was WAY to low.

I think what you're describing there is probably evidence supporting the case of defamation. Such emails and internal memos would likely show a reckless disregard for the truth.

It's mostly a question of state law and whether the defendant’s actions were malicious, intentional or grossly negligent... In the Gibson Bakery v. Oberlin College libel case, the jury initially assessed $11 million in compensatory damages and $33 million in punitive damages against Oberlin, for a total of $44 million, but the judge cut back the amount to $25 million because Ohio law has caps on damages. The judge then tacked on $6.5 million in attorney’s fees bringing the verdict back up to $31 million.

Although this is on appeal in Ohio, it's a good example of a case that didn't garner a fraction of the media Sandmann did. And I do believe Kentucky does not cap either compensatory or punitive damages.

There are no humans that originated in North America.

Being here first doesn’t make them native in the sense that people use the term.

Regardless of if showing up here first makes you a native, the people here when Europeans arrived weren't native.

Over the intervening 13k years they taken retaken killed and stole the land from each other 50x over.

The fact you share a skin tone with the people you drove off of land doesn't make you native. The entire concept of calling the people that were here in the late 1400s native is retarded
