This stupid bitch just argued that people with religious exemptions cannot get the vax therefore needs OSHA to mandate the vaccine to protect them.

on a nursing hospice Alzheimer's floor. OSHA ordered a permanent sign on housekeeping non commercial washer and dryers to say CLEAN THE LINT, because not CLEANING THE LINT causes a fire. And employees had to sign a sheet each shift, they checked it.

I wish the plantiffs could argue back on the "This isn't a vax mandate" bs..
It basically is, yes you are giving businesses the option, but its MUCH cheaper and easier just to impose vax than allow for testing.

Again, you can say that all you want--but it is not true
The determination of whether the vaccine puts people at Severe Risk or acceptable risk is itself a policy determination by OSHA. If OSHA is within its grant of authority from Congress to make that determination(which is the issue before the Court), then OSHA's determination stands and will not be touched by the Court. If they are not, the mandate will be stricken. Either way, the merits of the determination itself will not be touched.
Policy determinations are not subject to judicial review in federal courts in this country, so long as they are issued within a lawful grant of authority from Congress and/or the Constitution. The policy determinations made lawfully by the executive agencies are controlled/checked by elections--not the Court.
