Also, I am wrong as much as the next person. But not on the point of what is illegal and what is not.
ANYONE can watch that press conference for themselves and see that yes Comey said "Clinton broke the law,but no reasonable prosecutor would prosecute" and that's not even uncommon. In fact, prosecution for lying to the FBI when that's the only crime is more common than not prosecuting when crimes have been committed.

Respecting the idea of intent..
Here is the relevant section of statute.

Comey' original memorandum used "grossly negligent" referring to Hillary's actions but in his conference he wove the ideas of willfulness and intent into elements necessary for reasonable prosecution of her crimes. Intent is not necessary only gross negligence. One could make the case that intent is subsumed in the act of having a private server and using it for government purposes.
