Two federal death row inmates refuse Biden's commutation in continued fight to prove their innocence

Shannon Agofsky, 53, and Len Davis, 60, who are both in the U.S. Penitentiary in Terre Haute, Indiana, are refusing to sign the paperwork to accept the president's clemency action due to the legal avenues they are afforded on death row, according to court documents.

The pair filed emergency motions in federal court on Dec. 30 requesting an injunction to block the change to their death sentences, saying that accepting their commutations would remove the heightened scrutiny that death penalty appeals receive.

"To commute his sentence now, while the defendant has active litigation in court, is to strip him of the protection of heightened scrutiny," Agofsky's filing reads. "This constitutes an undue burden, and leaves the defendant in a position of fundamental unfairness, which would decimate his pending appellate procedures."

Davis, a former New Orleans police officer, "has always maintained that having a death sentence would draw attention to the overwhelming misconduct" against the Justice Department, he wrote in his filing.

But, as Davis noted, case law on this issue is "quite murky" and there is no guarantee the two inmates can have their death sentences restored.

Notably, the Supreme Court ruled in 1927 that a president may grant reprieves and pardons without the convict's consent. Both inmates wrote in their filings that they never requested commutation

This part is revealing. His team (not him because he’s in the fog of dementia) is just picking criminals they want to pardon based on their own motives. These aren’t people pleading for clemency, there is no research into these cases, just throwing out pardons lotto style.

Agofsky and his brother were convicted of kidnapping, robbery, and murder of a bank president in either Arkansas or Missouri (i forgot) . It was an episode on Unsolved Mysteries and FBI files. Pretty cruel way the bank president was killed.

Do the jailed parties have to sign off on it first to accept it? In the other thread on this same topic a couple days ago, those guys would be dumb to accept it based on it's only a commutation of their sentence, not a get outta jail free card.

That would give them zero leverage as they rot in prison for life.

bullshite, he granted clemency to 99% of all death row inmates in the country. The lotto left you on death row.

Sounds like they could challenge Biden's mental capacity if he's just imagining requests that aren't real.

That's what it sounds like the article is saying. They get heightened legal appeals on death row that they won't get with the regular jail sentence they'll be dropped down to

He was a good baw upset by climate change and was going to return to goat herding and having a family with apple pie cooling on the porch.

No, they don't. And they don't even have to be notified or asked, prior to receiving it.

It's interesting
A person can refuse a full pardon. It's seems as tho a commutation is different, if they're having to file against it.

Sadly, these things don't have to be requested.
And in his statement, his handlers said that this was an act to throw the middle finger at the death penalty.

Interestingly enough the reason this guy is on death row is not because of the murder if the bank president. He’s on or was on death row for killing a fellow inmate.
