Nothing in the 14th grants the parents of babies born in the US citizenship. All the EO has to say is that those parents have the option of putting the kid up for adoption or leaving the country with their kid.

The 14th addressed slavery and citizenship. Considering the importation of slaves was banned for a very, very long time when the 14th came along, 60 motherfricking years, that means the parents of slaves were all born in this country when enacted. Former slaves were citizens, as were their children. If you think that anyone, voting on this amendment even remotely intended it to include the offspring of Miguel and Maria hopping the border and popping out a baby 5 seconds later, and that child being a citizen, then you are ever more mentally deficient than anyone could ever imagine!

The historical analysis Thomas championed in Bruen was already done in Wong Kim Ark. Would be funny to see how much the DEMs have upset him to make him turn his back on his own crowning achievement and ignore the historical analysis he added to the originalism/textualism he claims to support.

I posted a literal op-ed from Gorsuch earlier talking about how it's bad to make the Constitution a living document, which is what they're trying to do with this EO

They might point to the statements of the person who authored the citizenship clause in the 14th amendment who said it wouldn’t apply to children born in the US to foreigners and aliens.
