It's predecessor was. DACA did nothing to remove what the 5th stated.
In addition to that, there has to be a lawsuit filed. None had been filed so there was no case for a court to rule on.
10 states stated that if the admin did not resend they would file. As I type, South Carolina announced they are dropping the suit because Trump rescinded DACA.

Either way, they're all staying because Trump turned an easy win (end DACA early and force Congress to act to give you something good) into an omnishambles.

If Trump and the GOP want to destroy the lives of 800,000 kids and young people that are here at no fault of their own then it's going to happen. But I'm not going to be upset when this does lasting damage to your party.
I've already said before I think many in the GOP are void of empathy, compassion, and have a hard time doing what's right. They certainly do a great job at reinforcing this perception.

I applaud the statement but this has already become an impossibility for Congress. The reason why is that Trump has no idea what he wants and so Huckabee Sanders came out a while ago saying, Trump wants DACA attached to Comprehensive Immigration.
