He criticized Justice Roberts for saying "tariffs are a tax and Congress has the power of the purse, so...." Tariffs are not a direct tax on the people. It raises the price on that product, but not necessarily all products. They can be used to formulate policy, deal with countries dumping their cheap product in the U.S., and evening things out with countries doing the same thing to the U.S. It can be an effective national security tool. Levin is a constitutional scholar.
