it's a "very thin" indictment because this is NOT what they will be charging him for. This was just to throw something on him before his SOL expired.

For the 18th time now.

I used to believe that, but EDVA is known as the rocket docket. Tight deadlines have already been set for the case. Dispositive pretrial motions are due in less than two weeks. Trial has been set for January. When the parties were working out a schedule with the judge today, that would have been the time for the prosecution to alert the court that they planned on bringing a superseding indictment.

The indictment is so thin that any superseding indictment is likely to be rejected as broadening the scope of the original charges too much.

FL Tech, ban bet? Seeing the team DOJ trotted out to get chewed up by Patrick Fitzgerald, I am now convinced that DOJ isn't serious about the case. That indictment is too narrow to save future charges from being time-barred.

So, I bet that no more federal charges will be "accepted" (judge will nuke them as time-barred) against Comey. If I am wrong, I won't post for 6 months (and you will be a hero to many).

You seem confident. Take the bet.

I think my question is did they rush the prosecution because the SOL was about to run out and they just wanted to get the case filed before that so it would give them more time to add charges.

That's a good question. Just from what happened today at Comey’s arrangement, personally, my guess is that they will be limited to this indictment.

Oh well, they got Al Capone for tax evasion rather than murder....

Being pro-Trump doesn't mean ignoring reality. Since I'm so uninformed, please inform me about the comparative excellence of the prosecution team versus the defense team.

Are you following the Garcia criminal trial in Nashville? This DOJ has been unimpressive so far, so it makes me think a good chance you are right.

Final bit of research. In setting the case schedule today, when asked by the judge, the prosecution estimated the January trial of this case to take three days. REALLY bad form not to disclose to the judge then that some miraculous superseding indictment was coming.

Believe all the Lucy-pulling-the-ball pundits you want. But these are the only federal charges for which Comey will be tried...which is a travesty...but it is what it is.

It does seem cowardly not to accept a ban bet when he has explained how he is right EIGHTEEN times.

Thanks, I haven't been. I just hope this isn't a pattern of over-promising in public relations and underperforming in prosecutions.

I REALLY hope Judge Dugan in Milwaukee is convicted. THAT appears like a solid prosecution, albeit in a liberal federal district...so, who knows.

Could be, I just don't understand the staffing decision by the Trump DOJ. Why not bring in your best federal prosecutor from ANYWHERE in the country? They don't have a better bench than a couple of inexperienced prosecutors from North Carolina?

The answer is simple: the control of government by the Trump administration is a mile wide and an inch deep.

They own the political appointees that have been approved and that’s basically it.

Thune and Johnson have refused to approve the second and third level picks.

Someone convinced Trump not to go ahead with Project 2025 which would’ve flooded DC with MAGA mid and senior managers, instead nothing happened and all the agencies are basically exactly as they were under Biden… just like we saw happen in the first term.

Either Trump is being isolated again due to bad advice or he’s unserious about cleaning out the agencies to begin with and we’re looking at another empty executive order presidential term.

It’s unfathomable after the assassination attempts and lawfare but it’s par for the course with the first four years.

Well, if there is going t be a superseding indictment, as many surmise, no one would care who is appointed the case would they?

Well, the judge worked with Comey and is a Biden appointee They probably know the case is gonna end up getting thrown out and redone, so they're just putting some crappy lawyers in on the front end and keeping their powder dry so that when this whole thing gets taken around the corner for the second round, then they can finally put somebody in who's going to make a difference with a Judge who's actually going to make a difference.

Trump named as the lead prosecutor an attorney who he must trust rather deeply (former personal atty) to supervise the undertaking, and keep it honest and diligent.

He actually fired the previous US Attorney (Seibert) because he refused to indict Comey or prosecute Letitia James, so he brought in Halligan. Notably she has never tried a criminal case and as an interim appointment, has not been confirms by the Senate. She is simply not qualified for the job.
