You don’t know that. She was using the vehicle as a weapon and was still in possession of the weapon.

How so? I am no certain, but I do not think there is any way the feds could stop Minnesota from charging anyone - including a federal agent - with a state crime.

Because he is acting on behalf of the federal government in his role. That makes the jurisdiction the federal courts.

If he was doing something off duty or not in his job description. The state would then have jurisdiction

If she was using her vehicle as a deadly weapon, the officer had all justification to shoot her dumb arse.

No chance

He's a federal agent defending his life.

Don't be surprised if the Trump administration doesn't sue Walz and Frey over this.

Lol Bull fricking shite. He was right in front of her.

She also tried blocking the ICE agents with her car which is aggressive and potentially life threatening.

The woman was unjustified in hitting the ICE agent with her vehicle. Was ICE justified by "self defense" in shooting her? Hard to tell from that video.

you answered your own question: The woman was unjustified in hitting the ICE agent with her vehicle

And, not hard to tell, as you clearly stated fact - the woman used her car as a weapon against the agent.

Left will make the Charlie Kirk murder look like a speeding ticket compared to this. And the MSM will eat it up.

It does not mean that the State cannot file state charges against the federal official.

They can try. But the DOJ is going to immediately file to have it moved to federal court. And they are going to win it.

This may finally stop some of these karens thinking they can assault federal law enforcement with no repercussions.

A couple more of these and they might just start behaving like normal citizens instead of entitled idiots.

What kind of fcking idiot thinks they can drive their car into the middle of a road block, refuse to open the car door, and then gun it to run over an officer?

Nevermind I see a couple of them in this thread, go ahead you guys try it....make their day

The lack of reading comprehension on this board is astounding.

I said IF the ICE agent is put on trial by the State of MN then he is fricked- ala Derick Chauvin.

Federal law enforcement can not face state charges for actions that occur while performing their federal duties.

But this isn’t the supremacy clause.

The Supreme Court disagrees

Supremacy Clause Immunity: The Constitution makes federal law "the supreme Law of the Land," which generally prevents states from interfering with valid federal operations. This principle protects federal agents from state prosecution for acts authorized by federal law and reasonably necessary to fulfill their duties.

David Butler Neagle (October 10, 1847—November 28, 1925) was a Deputy U.S. Marshal who, while guarding Associate Supreme Court Justice Stephen J. Field, killed former California Chief Justice David S. Terry when he assaulted Field. Neagle was arrested by the county sheriff and charged with murder. Insisting he was acting within his capacity as a federal marshal, his case went to the U.S. Supreme Court, which in In re Neagle affirmed the executive branch's right to protect judges and the supremacy of federal law over state law.

In re Neagle US ( (Cunningham v. Neagle 1890)

Interesting side note when Marshall Virgil Earp was assassinated playing pool, Tombstone elected Neagle their new Marshall a week later.

It's not only that. There is only information cooperation between the Feds and state and local only through agreements.

I spoke to a revenue agent working a client one time and a city had subpoenaed the revenue agent to provide information on a person in his inventory that they wanted to speak to about some other thing. The revenue agent gave the subpoena to IRS disclosure that informed the local detective that the subpoena was not going to be answered because of federal law and they could withdraw it. The local detective, apparently with an ego, then threatened to have the judge issue an arrest warrant for the revenue agent. The IRS then promptly told them that if they wanted to challenge the federal agents at the Treasury Inspector General's office to serve that arrest warrant, they were free to do so.

He said he never heard another thing about it.

How the hell are they gonna be able to get him a fair trial, in MN when the mayor and Governor both said he committed murder.Any decent attorney should be able to handle that.

Reverse lights off (car in drive) and agent standing right there in front of the car.

Also, deadly force is authorized if there is risk of death OR serious bodily harm. That risk was definitely applicable in that moment.

ETA - you can see his weapon is already being pulled from the holster because she had put.the car in drive and started toward him
