Did you not listen to the video???? That's the crux of Millers point!!! Define facilitate!
AND this guy was a member of a designated terrorist organization, which disqualifies the Holding Order.

Miller may be my favorite in the whole administration

Apparently, Miller was recovering from a hangover the day they taught that in his Poli Sci course at Duke.
So POTUS is not obliged to honor the court order from SCOTUS when it is inconvenient to POTUS ?

Appreciate the concern, but it’s obvious that you haven’t recovered from the smooth brain that afflicts you. The mental gymnastics it takes to arrive at the conclusion you just laid out is astounding. Intentionally disingenuous, regards.

Genuine Question: why didn't Government move to overturn the Holding Order?

thank God you're here to tell everyone why the USSC was unanimously wrong in their ruling, as well as how the administration SHOULD be interpreting all of this. Its just incredible that a slapdick poster on TR is so much more knowledgeable than all these other misguided judges and bureaucrats.

Jane you filthy slut. You know or should know that if El Salvador was to want him sent back here, that we would, as Trump stated, send a plane. Then once he got back here, in compliance with the court order, send his arse straight back to El Salvador to fulfill he deportation order status.

You did not listen very well, he said if you are a member of that MS13 Gang, you can not have a WITHOLD ORDER. Boom, case closed.
That makes the Withholding order null and void.

Again, you did not listen verry well, the SC said the least that the current Gov. (Trump admin.) could do would be to facilitate a return, but that has to be contingent (DUH) on whether his native country of El Salvador wants to send him back to the USA and THEY DON'T..........thus end of story. PERIOD.
The Supreme Court is not stupid enough to mandate anything to a foreign country. Its LOONY TUNES THINKING.
All Dems are loony tunes lovers I guess.

SCOTUS said that the administration should facilitate his return, which is what I am arguing. Maybe you should learn to read.
Directly from the order:
quote:
The order properly requires the Government to “facilitate” Abrego Garcia’s release from custody in El Salvador and to ensure that his case is handled as it would have been had he not been improperly sent to El Salvador. The intended scope of the term “effectuate” in the District Court’s order is, however, unclear, and may exceed the District Court’s authority. The District Court should clarify its directive, with due regard for the deference owed to the Executive Branch in the conduct of foreign affairs. For its part, the Government should be prepared to share what it can concerning the steps it has taken and the prospect of further steps.

Omg!!!
I supplied the definition of "facilitate".
Trump can't force another country to do as it wishes with one of it's own legal citizen's. If the country decides to send their legal citizen back to the US, Trump has been directed to "facilitate ", to make it easy or easier.

facilitate:

It was never a valid Holding Order. This person was disqualified from receiving one, because he's a member of a terrorist organization. This has been explained several times now.

That is why SCOTUS took out "effectuate" from the District Judge's order. A district court judge can't order the Executive how to perform foreign affairs.
All Trump has to tell Bukele they are going to have a plane there on this date to facilitate his return and comply with the order. If Bukele lets him out of CECOT at that point is up to Bukele.

What's the problem?

Thanks for your patience. The Trump-employed Immigration Judge was aware that Garcia was a member of a terrorist organization and STILL issued the Holding Order?

You are wrong. His grant was in 2019, and the order adding MS-13 to the list was on February 20, 2025. So for ~6 years it was a completely valid order.
There are procedures to take if the government wants to revoke his Withholding of Removal status that they did not take. That is the issue, at least for me. Can care less if he is removed ultimately, especially if he is actually an MS-13 member, but follow the law and due process requirements we have codified or change the law.
