Article 4, Section 4, US Constitution:

The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence.

Trump's emergency declaration is to force the legislature to fulfill a constitutional mandate which it has ignored for decades. A mandate which protects American citizens, protects the sovereignty of the United States, and will save hundreds of millions of dollars that are spent each year supporting illegal aliens who have no right to be here, much less be supported by the American taxpayer.

Feel free to post up any of Obama's executive orders or emergency declarations that even sniff these parameters.

This says that the United States shall protect the states against invasion. It does not give the president authority to act outside of Separation of Powers.

My arse. There is statute after statute that says the president has the power to do this, at his discretion. The President speaks and acts for the United States every damn day.

Separation of powers doesn't have a damn thing to do with pissing on a Constitutional mandate. Neither the President, nor the legislature, nor the judiciary, has the right, power, or the option to piss on the US Constitution!

You're right. Congress expressly granted that authority to the president. If you don't like it, sue. Let the USSC rule on it.

I hadn't heard that McConnell made that argument but it's stupid. I'm not a McConnell supporter though, nor am I much of a fan of congress, so that's kind of apples and oranges here.

Congress didn't do its' job here, and I think most can agree to at least that much. It became Pelosi and Schumer holding both parties - and Trump - hostage. The likes of McConnell and the other repubs didn't do enough either.

Trump did the only thing he - and only he - could do. I won't ever fault him for that. I never complained about Obama doing it either, for the record; I could find plenty of other faults without. EOs are just part of the job.

Negative. I didn’t like when Obama did it and I don’t like that Trump has done it.

I agree we need something done at the border but this isn’t the way to do it. No matter democrat or republican president.
