Why is it ok to take the constitution literally here, but not for the 2a?

Let me guess... you are a HUGE defender of the 2a, right?

Unfortunately it is to count all persons. And they count for the purpose of representation = unless we enact some sort of 3/5 amendment to stop it.

We certainly need an amendment now that restricts representation to citizens only.

Ideologically, I do not think that noncitizens should be included in the count for purposes of apportionment. That is really irrelevant. Constitutionally, it is not even a close call.

This entire debate on the “don’t count them“ side boils down to people claiming the constitution says something because they think it SHOULD say that thing.

Rather like Roe. That Court agreed with the deluded. I rather doubt that this court would do so.

Pretty accurate take actually.

It LITERALLY says Free Persons, so we need to incarcerate all Illegal Aliens, therefore not Free but rather imprisoned for their illegality, therefore not counted!

ETA: could also simply declare all illegals status as "under arrest" although not in custody, and voila, not Free.

If you want to know how many people are here, yes.

If you want to know how many people are represented in a voting district, no.

If you want to know how many citizens are in the country, no.

There’s positives and negatives about counting them.

Maybe the constitution foolishly assumed we would actually enforce immigration law and national sovereignty and wouldn’t have to account for politicians absconding their duties and allowing tens of millions of fricking foreign nationals into our country.
What were the immigration laws in 1789?

HINT:
Anyone who wanted to move here could move here at will. “free White persons” could apply for and be granted citizenship by showing any court that they had “good character.”. There was no such notion as that of “illegal alien.”. See the immigration Act of 1790. (before 1790, there was ZERO “immigration law.”)

I do not know. I believe that the 2nd Amendment precludes the federal government from interfering with ownership of any firearm that would be carried by a state or local militiaman, regardless of whether the owner is actually a member of a militia, including fully-automatic rifles.

Do you consider that to be support or not?

I mean no personal offense, but that is REALLY weak.

What exactly IS weaker than “grasping at straws.”. Perhaps “right to privacy, Ms. Roe?”

HELL NO, we don't recognize subjects of ANOTHER COUNTRY around here, anyone who argues otherwise is full of shite and doesn't believe in a country's sovereignty

Yep.

We need to know approximately how many there are.

Is there a law that only citizens are allowed to vote?

Only citizens of the US should have representation. Legal aliens or illegal aliens are just guests in this country. They have no standing on our laws.
Census should only count US citizens. Criminals should be arrested for breaking our laws whether they are citizens, not citizens, the prez, an ex-prex, or HRC.

You commit a crime, you do the time.

That's what I'm talking about right there, our government shouldn't be representing subjects of other countries, that's absurd and implies we might be pawns to foreign interests, only AMERICAN CITIZENS deserve representation in the AMERICAN GOVERNMENT.

When the Framers drafted the 2nd Amendment, the people possessed artillery and cannons in their homes, if we're true originalists basically all these constitutional limitations on weapons are constitutionally null and void, Judge Posner drove that point vociferously home in his opinion in Moore v. Madigan (not the same opinion but very pro-gun rights) as great as Heller was it really was a snow job from an originalist perspective, can't deny it

Weaker than grasping at straws? You mean like a report, and not even by an eyewitness but some unnamed 3rd party hearsay, of hookers peeing on a bed being some Russian Collusion evidence? That kinda weak?

Did they count Indians?

Nope, because they were considered citizens of their own sovereign nations.

Which is why it is dumb for anyone to think that the drafters of the legislation intended to count anyone that is a citizen of a foreign country only for representation in the House.

Well illegals aren't free persons. So that's that.

Understood. If we address the base issue then your question becomes irrelevant. But, as you point out since they are here, I think they should be counted but not considered for the allocation of monies excepting those monies which would be used for deportation.

This and not only for allocation of funds, they should also not be included in congressionaldistricts nor electoral votes.Watch what happens to NY/cali representation then.

While they are here, they should be counted, and the states they reside in noted. Upon any federal election their numbers should be subtracted from the demoncrap side's total vote.

I don't favor deportation for illegals, I favor lynching.

Seriously, they should be counted, but not included in any form of government representation. Counting them is needed to find out how many are actually here and where they are located. This will make deportation easier and more efficient.
