The 400 million in principle from 1979 MoU was clearly money belong to a foreign government, which the US had been contractually required to place in an interest-bearing account… though we did not do so.
Because we breached that agreement, we clearly owed interest… Though the amount was in dispute. It could’ve been $1.4 billion, and it could have been more or less than that sum dependent upon the finding of the ultimate tribunal (which had not yet issued).
The US government had a subrogated right to retain approximately $400 million of the interest payable (the fact that the figure is the same as the original principal was a coincidence), but waived that right as part of the overall settlement.
If the ultimate interest award had exceeded $1.8 billion, then waiver of the subrogation rights was a good deal. If the ultimate award had been (for instance) $1 billion, waiver of those rights would’ve been “taking a bath.”
it is a sort of gamble that people make every day when they settle a lawsuit. They evaluate the risks, the potential upside, and the potential downsides. Then they make an informed judgment.

We agreed to the arbitration under Reagan AFTER the hostages were released. Man, there are a bunch of people on this board that don’t like laws or honor their word. I’m still waiting on a single valid reason why we wouldn’t give them their money back AFTER we agreed to do so other than “they don’t like us or we don’t like them”.

The Chavez/Maduro regime will eventually fall and be replaced, and Exxon will still have its judgment. The new regime will have significant incentives to resolve the claims, in order to rejoin the community of nations.
BTW, the figure is $1.8 billion, not $18 billion. You are off by a factor of ten.

Just a reminder for anyone who wants to actually UNDERSTAND the settlement between Iran and the US ... the Brookings Institute has provided a very good, concise and objective summary here.
If there exists a reasonably-neutral think tank in DC, it is Brookings. The Far Right insists that it is Leftist, and the Far Left insists that it is Fascist. I cannot imagine better evidence of neutrality.
So, you can read the Brookings summary and obtain a decent (if somewhat basic) understanding of the real facts, or you can choose to continue relying upon the slanted analysis provided by the far Right or the Far Left. The choice is yours.
