President's Authority to Declassify Does Not Extend to Nukes

This is the current talking point. Atlantic just published an article about it. They are arguing that the Atomic Energy Act of 1948 gives sole classification authority (concerning nukes) to DOE and the president cannot override it. This is what they will try to "get Trump" on.
However, I am not sure how that will play out in court. The constitution is pretty clear that the President is the final authority on such matters. And the DOE is part of the executive branch.

Which is why this is a shite take.

Why would he want to declassify that? Unless it relates to certain dealings with Iran with the previous administration.

I love how, with absolutely no confirmation whatsoever, the media has decided that the nuke rumor is true to the point where they're discussing the nuances of a nuke-related prosecution against Trump.

Ummm we just speeding past the “ wtf does he have nuke secrets” part??? Umm why does he have them..classified or not???

The United States media is the most effective propaganda weapon in the world. We don't need a hardline authoritarian regime for people to be brainwashed.

It really is peculiar. Did they just now realize he had something damning declassified sitting at Mar-a-lago, or did they purposely wait until closer to midterms to try to do the most damage? Either way it's not a good look.
EVEN IF what they say is true and he had these super top secret and dangerous documents sitting there, it took them 18 months?
None of it adds up

Because unverified people with presumably no access to the files say he does? Jesus you are a sheep.

It’s because literally nukes are the only thing that would approach justifying what they did Monday.
And even then if true, which it’s not, it’s still an over reach

I can't imagine him being that foolish. I can't think of any non nefarious reason.
I'm still leaning towards an overreaction.

Even Sam Harris is still falling for this horseshite. It's actually impressive to watch.

Yeah man! The billionaire that became POTUS after never being a politician before, and being investigated for the last 6 years under a million microscopes for every little thing he's ever done, while walking away totally unscathed from those countless investigations is really stupid.
I wish I could be that stupid.

Haven’t seen any evidence Nuclear material was in any of the “classified” seized, just WP spin and wishcasting. And even if it was this is a Hail Mary of schemes to get him!

Department of Energy ? How could the Atomic energy act of 1948 give sole classification authority to a department (DOE) that was established in 1977 ?

Did you fall for the Trump/Russia collusion hoax? Do you still believe Trump is a Russian asset? If you answered yes to both questions I can see why you believe Trump really has top secret/SAP nuclear documents in his possession. Do you TDS lunatics ever tire of being wrong? Lol

Department of the Navy vs Egan (1988)
They have no legitimate (nor legal) argument here.
quote:
The President, after all, is the "Commander in Chief of the Army and Navy of the United States." U.S.Const., Art. II, § 2. His authority to classify and control access to information bearing on national security and to determine whether an individual is sufficiently trustworthy to occupy a position in the Executive Branch that will give that person access to such information flows primarily from this constitutional investment of power in the President, and exists quite apart from any explicit congressional grant.
quote:
The authority to protect such information falls on the President as head of the Executive Branch and as Commander in Chief.
They have no legitimate (nor legal) argument here.
