Your memorandum is based on the indictment and prosecution of a sitting president

You know trump is not yet that, correct

Of course you do but you are in able of understanding the application of laws to facts

Not at all. This is standing DOJ policy. The DOJ can't prosecute a sitting President, as the DOJ sees it as a Separation of Powers issue

Although I am glad he won the election, he is not inaugurated, so he is not the sitting president, is he?
His opposition using this policy as the reason to drop charges and cases is a poor excuse to save face.

Very good for Trump that he doesn't have to oversee that particular "Constitutional crisis"

Curious what NY/GA do now

Literally what I'm doing.

The memo is why they're dismissing the cases. I don't understand your malfunction.

There are many policies the DOJ have violated. That is is the scapegoat, not ghe reason.

They're doing him a favor.

It's following DOJ policy.

Trial is not possible prior to inauguration. The only way Trump isn't President is if he dies, which makes the cases moot.

In the extremely unlikely scenario he resigns prior to inauguration (not sure if he can even do that), they'd re-file the indictments.

Which lies, specifically?
quote:

“The statute says the following, two or more persons conspire to injure and deny somebody the free exercise or enjoyment of any right or privilege secured him by the constitution. What if a court ultimately rules that Donald Trump had a right under the First Amendment to make his Jan. 6 speech and to do what he did? Then Jack Smith will have conspired to deny him of that right. That’s how serious this is.”

“Jack Smith … deliberately, willfully and maliciously leaves out the words that President Trump spoke on Jan. 6 in his speech.... what he said was, ‘I want you to assemble peacefully and patriotically,’” Dershowitz added. “Jack Smith leaves that out. That is a lie, a lie, an omission lie and if you’re going to indict somebody for telling lies, don’t tell lies in the indictment. If you’re going to indict somebody for denying people their constitutional rights, don’t deny them their constitutional rights by indicting them for free speech. That’s how hypocritical this is.”

No.
Because if it was, they wouldn't be "doing him a solid." They'd simply be following their own directives.

We'll never know if it qualifies, since this won't go to a jury.

They'd be following their directives to dismiss the suit, you mean? Which is what they did?

If there is one thing I have always said about the doj/garland/smith is that they are always doing favors for those they are prosecuting

If I've seen it once I've seen it a million times

Smith's nickname is "favor man"
