Hard to argue against this. Seems like states should absolutely challenge EOs that are unconstitutional.

They just formalized the review process.

This needs to happen in every conservative state. Most of these executive orders are unconstitutional. An XO really should only order a Federal Agency to have a certain policy or to take a certain action. He has no authority to order states or citizens to follow his directives.

This should have been resolved by the Supreme Court years ago and they keep side stepping it.

I totally agree with this statement. However, if the last twenty or so years have taught us anything, it’s that the unconstitutional is seemingly constitutional if the feds want it done.

It is great to see states finding ways to fight back. Would be good to see if one could figure out how to fight this new wuflu relief bill. Thing is crazy.....(eta: adding in obligatory...Thanks Georgia)

I love the idea of this, but does anyone with more legal knowledge than me know what’s to stop the states and feds from just claiming they can keep overruling each other’s orders?

I've not read the entire bill but I would think that disproportionate relief to poorly managed blue states and pensions should be a challenge that could get some traction. Our state requires a balanced budget but our public retirement system is better funded than some, it too has significant unfunded liabilities. I'm not proposing they bail us out but rather throw all of the others out.

This country was originally set up for the states to have the power and for the federal government to be small. Lincoln screwed that up.

People need to wake up and realize that the SCOTUS is never going to save the USA from the Radical Left.

The law schools of the USA exist SOLELY to reinforce the Radical Left's grip on the US Judicial system!
